 1-7                            A BILL TO BE ENTITLED
 1-8                                   AN ACT
 1-9     relating to a school district's release of certain student
1-10     directory information.
1-11           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-12           SECTION 1.  Section 552.114, Government Code, is amended by
1-13     amending Subsection (a) and adding Subsection (c) to read as
1-14     follows:
1-15           (a)  Information is excepted from the requirements of Section
1-16     552.021 if it is:
1-17                 (1)  information in a student record at an educational
1-18     institution, other than a public school district, funded wholly or
1-19     partly by state revenue; or
1-20                 (2)  information in a student record at a public school
1-21     district and not designated by the district as directory
1-22     information, as that term is defined by the Family Educational
1-23     Rights and Privacy Act of 1974 (20 U.S.C. Section 1232g(a)) and its
1-24     subsequent amendments.
1-25           (c)  A public school district may designate as directory
1-26     information any or all information defined as directory information
1-27     by the Family Educational Rights and Privacy Act of 1974 (20 U.S.C.
1-28     Section 1232g(a)) and its subsequent amendments.  A district must
1-29     comply with the Family Educational Rights and Privacy Act of 1974
1-30     (20 U.S.C. Section 1232g) and its subsequent amendments before
1-31     releasing any designated directory information.
1-32           SECTION 2.  This Act takes effect September 1, 2001.
