                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the amount of tuition that a public institution of
 1-3     higher education must set aside for Texas Public Education Grants.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 56.033(a), Education Code, is amended to
 1-6     read as follows:
 1-7           (a)  The governing board [boards] of each institution
 1-8     [institutions] of higher education, including [and] the Texas State
 1-9     Technical College System, shall cause to be set aside:
1-10                 (1)  except as otherwise provided by Subdivisions (3)
1-11     and (4), 7.5 [for the 1991-1992 academic year, not less than nine
1-12     percent nor more than 15 percent out of each resident student's
1-13     tuition charge under Section 54.051 of this code as provided by the
1-14     General Appropriations Act for the applicable academic year;]
1-15                 [(2)  for the 1992-1993 academic year and each
1-16     subsequent academic year, not less than 15 percent nor more than
1-17     20] percent out of each resident student's tuition charge under
1-18     Section 54.051 [of this code as provided by the General
1-19     Appropriations Act for the applicable academic year; in specifying
1-20     the percentage to be set aside for the 1991-1992 and 1992-1993
1-21     academic years, the legislature shall consider the recommendations
1-22     of the Select Committee on Higher Education established by H.C.R.
1-23     No. 105, Acts of the 69th Legislature, Regular Session, 1985];
1-24                 (2) [(3)]  three percent out of each nonresident
 2-1     student's tuition charge under Section 54.051 [of this code];
 2-2                 (3) [(4)]  six percent out of each resident student's
 2-3     hourly tuition charge, and $1.50 out of each nonresident student's
 2-4     hourly tuition charge, for academic courses at a public community
 2-5     or [and] junior college [colleges]; and
 2-6                 (4) [(5)]  six percent of hourly tuition charges for
 2-7     vocational-technical courses at a public community or [and] junior
 2-8     college [colleges].
 2-9           SECTION 2.  (a)  This Act takes effect immediately if it
2-10     receives a vote of two-thirds of all the members elected to each
2-11     house, as provided by Section 39, Article III, Texas Constitution.
2-12     If this Act does not receive the vote necessary for immediate
2-13     effect, this Act takes effect September 1, 2001.
2-14           (b)  The change in law made by this Act applies beginning
2-15     with the 2001 fall semester.
