1-8 AN ACT
1-9 relating to the creation, composition, and operation of certain
1-10 district courts.
1-11 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-12 SECTION 1. Subchapter C, Chapter 24, Government Code, is
1-13 amended by adding Section 24.542 to read as follows:
1-14 Sec. 24.542. 397TH JUDICIAL DISTRICT (COLLIN COUNTY). The
1-15 397th Judicial District is composed of Collin County.
1-16 SECTION 2. (a) Subchapter C, Chapter 24, Government Code,
1-17 is amended by adding Section 24.556 to read as follows:
1-18 Sec. 24.556. 412TH JUDICIAL DISTRICT (FANNIN COUNTY). The
1-19 412th Judicial District is composed of Fannin County.
1-20 (b) The heading to Section 24.106, Government Code, is
1-21 amended to read as follows:
1-22 Sec. 24.106. 6TH JUDICIAL DISTRICT ([FANNIN,] LAMAR[,] AND
1-23 RED RIVER COUNTIES).
1-24 (c) Subsection (a), Section 24.106, Government Code, is
1-25 amended to read as follows:
1-26 (a) The 6th Judicial District is composed of [Fannin,]
1-27 Lamar[,] and Red River counties.
1-28 (d) The heading to Section 24.482, Government Code, is
1-29 amended to read as follows:
1-30 Sec. 24.482. 336TH JUDICIAL DISTRICT ([FANNIN AND] GRAYSON
1-31 COUNTY [COUNTIES]).
1-32 (e) Subsection (a), Section 24.482, Government Code, is
1-33 amended to read as follows:
1-34 (a) The 336th Judicial District is composed of [Fannin and]
1-35 Grayson County [counties].
1-36 SECTION 3. Subchapter C, Chapter 24, Government Code, is
1-37 amended by adding Section 24.557 to read as follows:
1-38 Sec. 24.557. 413TH JUDICIAL DISTRICT (JOHNSON AND SOMERVELL
1-39 COUNTIES). The 413th Judicial District is composed of Johnson and
1-40 Somervell counties.
1-41 SECTION 4. Subchapter C, Chapter 24, Government Code, is
1-42 amended by adding Section 24.558 to read as follows:
1-43 Sec. 24.558. 414TH JUDICIAL DISTRICT (NACOGDOCHES COUNTY).
1-44 The 414th Judicial District is composed of Nacogdoches County.
1-45 SECTION 5. Subchapter C, Chapter 24, Government Code, is
1-46 amended by adding Section 24.559 to read as follows:
1-47 Sec. 24.559. 415TH JUDICIAL DISTRICT (TRAVIS COUNTY).
1-48 (a) The 415th Judicial District is composed of Travis County.
1-49 (b) The 415th Judicial District shall give preference to
1-50 civil cases.
1-51 SECTION 6. Subchapter C, Chapter 24, Government Code, is
1-52 amended by adding Section 24.560 to read as follows:
1-53 Sec. 24.560. 416TH JUDICIAL DISTRICT (MCLENNAN COUNTY). The
1-54 416th Judicial District is composed of McLennan County.
1-55 SECTION 7. (a) The heading to Section 24.113, Government
1-56 Code, is amended to read as follows:
1-57 Sec. 24.113. 12TH JUDICIAL DISTRICT (GRIMES, [LEON,]
1-58 MADISON, AND WALKER COUNTIES).
1-59 (b) Subsection (a), Section 24.113, Government Code, is
1-60 amended to read as follows:
1-61 (a) The 12th Judicial District is composed of Grimes,
1-62 [Leon,] Madison, and Walker counties.
1-63 (c) Section 24.455, Government Code, is amended to read as
1-64 follows:
2-1 Sec. 24.455. 278TH JUDICIAL DISTRICT (GRIMES, [LEON,]
2-2 MADISON, AND WALKER COUNTIES). The 278th Judicial District is
2-3 composed of Grimes, [Leon,] Madison, and Walker counties.
2-4 (d) Section 24.514, Government Code, is amended to read as
2-5 follows:
2-6 Sec. 24.514. 369TH JUDICIAL DISTRICT (ANDERSON, [AND]
2-7 CHEROKEE, AND LEON COUNTIES). The 369th Judicial District is
2-8 composed of Anderson, [and] Cherokee, and Leon counties.
2-9 SECTION 8. (a) This Act takes effect September 1, 2001.
2-10 The 397th, 412th, 413th, 414th, and 416th judicial districts are
2-11 created September 1, 2001, and the 415th Judicial District is
2-12 created September 1, 2002.
2-13 (b) The local administrative district judge shall transfer
2-14 all cases from Fannin County that are pending in the 6th District
2-15 Court or the 336th District Court on the effective date of this Act
2-16 to the 412th District Court.
2-17 (c) The local administrative judge shall transfer all cases
2-18 from Leon County that are pending in the 12th District Court or the
2-19 278th District Court on the effective date of this Act to the 369th
2-20 District Court.
2-21 (d) When a case is transferred from one court to another as
2-22 provided by Subsection (b) or (c) of this section, all processes,
2-23 writs, bonds, recognizances, or other obligations issued from the
2-24 transferring court are returnable to the court to which the case is
2-25 transferred, as if originally issued by that court. The obligees
2-26 in all bonds and recognizances taken in and for a court from which
2-27 a case is transferred, and all witnesses summoned to appear in a
2-28 court from which a case is transferred, are required to appear
2-29 before the court to which a case is transferred as if originally
2-30 required to appear before the court to which the transfer is made.
