                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the tuition for law school and graduate and
 1-3     professional pharmacy courses at public institutions of higher
 1-4     education.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1.  Section 54.008, Education Code, is amended by
 1-7     amending Subsections (a) and (f) and adding Subsection (g) to read
 1-8     as follows:
 1-9           (a)  The tuition rates provided by Subchapter B of this
1-10     chapter are minimum rates.  Except as provided by Subsections
1-11     [Subsection] (e), (f), and (g), the governing board of each
1-12     institution of higher education shall set tuition for graduate
1-13     programs for that institution at a rate that is at least equal to
1-14     that prescribed by Subchapter B [of this chapter], but that is not
1-15     more than twice the rate prescribed by Subchapter B [of this
1-16     chapter].  Between the maximum and minimum rates, the board may set
1-17     the differential tuition among programs offered by an institution
1-18     of higher education.
1-19           (f)  The governing board of an institution of higher
1-20     education shall set tuition for an undergraduate pharmacy program
1-21     at the institution at a rate that is at least equal to the rate
1-22     prescribed by Subchapter B [of this chapter] but not more than
1-23     twice the rate prescribed by Subchapter B [of this chapter].  The
1-24     governing board of an institution of higher education shall set
1-25     tuition for a graduate or professional pharmacy program at the
 2-1     institution at a rate that is at least equal to the rate prescribed
 2-2     by Subchapter B but not more than three times the rate prescribed
 2-3     by Subchapter B.
 2-4           (g)  The governing board of an institution of higher
 2-5     education shall set tuition for a law school at the institution at
 2-6     a rate that is at least equal to the rate prescribed by Subchapter
 2-7     B but not more than three times the rate prescribed by Subchapter
 2-8     B.
 2-9           SECTION 2.  This Act takes effect immediately if it receives
2-10     a vote of two-thirds of all the members elected to each house, as
2-11     provided by Section 39, Article III, Texas Constitution.  If this
2-12     Act does not receive the vote necessary for immediate effect, this
2-13     Act takes effect September 1, 2001.
