                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the tuition for law school and graduate pharmacy
 1-3     courses at public institutions of higher education.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 54.008, Education Code, is amended by
 1-6     amending Subsection (a) and adding Subsection (g) to read as
 1-7     follows:
 1-8           (a) The tuition rates provided by Subchapter B of this
 1-9     chapter are minimum rates.  Except as provided by Subsections
1-10     [Subsection] (e) and (g), the governing board of each institution
1-11     of higher education shall set tuition for graduate programs for
1-12     that institution at a rate that is at least equal to that
1-13     prescribed by Subchapter B of this chapter, but that is not more
1-14     than twice the rate prescribed by Subchapter B of this chapter.
1-15     Between the maximum and minimum rates, the board may set the
1-16     differential tuition among programs offered by an institution of
1-17     higher education.
1-18           (g)  The governing board of an institution of higher
1-19     education shall set tuition for a law school or a graduate pharmacy
1-20     program at the institution at a rate that is at least equal to the
1-21     rate prescribed by Subchapter B but not more than three times the
1-22     rate prescribed by Subchapter B.
1-23           SECTION 2.  This Act takes effect immediately if it receives
1-24     a vote of two-thirds of all the members elected to each house, as
 2-1     provided by Section 39, Article III, Texas Constitution.  If this
 2-2     Act does not receive the vote necessary for immediate effect, this
 2-3     Act takes effect September 1, 2001.
