 1-7                            A BILL TO BE ENTITLED
 1-8                                   AN ACT
 1-9     relating to the tuition for law school and graduate and
1-10     professional pharmacy courses at public institutions of higher
1-11     education.
1-12           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-13           SECTION 1.  Section 54.008, Education Code, is amended by
1-14     amending Subsections (a) and (f) and adding Subsection (g) to read
1-15     as follows:
1-16           (a)  The tuition rates provided by Subchapter B of this
1-17     chapter are minimum rates.  Except as provided by Subsections
1-18     [Subsection] (e), (f), and (g), the governing board of each
1-19     institution of higher education shall set tuition for graduate
1-20     programs for that institution at a rate that is at least equal to
1-21     that prescribed by Subchapter B [of this chapter], but that is not
1-22     more than twice the rate prescribed by Subchapter B [of this
1-23     chapter].  Between the maximum and minimum rates, the board may set
1-24     the differential tuition among programs offered by an institution
1-25     of higher education.
1-26           (f)  The governing board of an institution of higher
1-27     education shall set tuition for an undergraduate pharmacy program
1-28     at the institution at a rate that is at least equal to the rate
1-29     prescribed by Subchapter B [of this chapter] but not more than
1-30     twice the rate prescribed by Subchapter B [of this chapter].  The
1-31     governing board of an institution of higher education shall set
1-32     tuition for a graduate or professional pharmacy program at the
1-33     institution at a rate that is at least equal to the rate prescribed
1-34     by Subchapter B but not more than three times the rate prescribed
1-35     by Subchapter B.
1-36           (g)  The governing board of an institution of higher
1-37     education shall set tuition for a law school at the institution at
1-38     a rate that is at least equal to the rate prescribed by Subchapter
1-39     B but not more than three times the rate prescribed by Subchapter
1-40     B.
1-41           SECTION 2.  This Act takes effect immediately if it receives
1-42     a vote of two-thirds of all the members elected to each house, as
1-43     provided by Section 39, Article III, Texas Constitution.  If this
1-44     Act does not receive the vote necessary for immediate effect, this
1-45     Act takes effect September 1, 2001.
