1-1 SENATE CONCURRENT RESOLUTION
1-2 WHEREAS, Cyral and Patricia Farley allege that just as
1-3 several property owners prevailed in Brainard v. State, 12 S.W.3d 6
1-4 (Tex. 1999), Cyral and Patricia Farley are the rightful owners of
1-5 the following real property and premises, extending to the banks of
1-6 the Canadian River, located in Hutchinson County, Texas:
1-7 (a) All of Section 55, Block 46, H.&T.C. RR Survey,
1-8 Hutchinson County, Texas, save and except:
1-9 A 44.7 acre tract in Section 55, Block 46, H&TC RR
1-10 Survey, Hutchinson County, Texas. Said tract being
1-11 more particularly described as follows:
1-12 Beginning at a 1 1/4 inch rod marking the southeast
1-13 corner of said Section 55;
1-14 Thence N 89 47' 14" W along the south line of said
1-15 Section 55 a distance of 2638.0 feet;
1-16 Thence N 1 21' E along a barbed wire fence a distance
1-17 of 48.7 feet;
1-18 Thence 62 34' E along a barbed wire fence a distance
1-19 of 2930.2 feet;
1-20 Thence N 61 42' E along a barbed wire fence a distance
1-21 of 47.1 feet;
1-22 Thence S 0 12' 46" W along the east line of said
1-23 Section 55 a distance of 1430.7 feet to the point of
1-24 beginning.
2-1 (b) All of Sections 56, 57, 58, 59 and 60, all in Block 46,
2-2 H.&T.C. Ry. Co. Survey; and
2-3 (c) All of the following property situated in block 47, H&TC
2-4 Ry. Co. Survey,

2-17 WHEREAS, Cyral and Patricia Farley seek to establish their
2-18 right to possession of and good and marketable title to the above
2-19 referenced property; now, therefore, be it
2-20 RESOLVED by the Legislature of the State of Texas, That Cyral
2-21 and Patricia Farley are granted permission to sue the State of
2-22 Texas and the General Land Office subject to Chapter 107, Civil
2-23 Practice and Remedies Code; and, be it further
2-24 RESOLVED, That the commissioner of the General Land Office be
2-25 served process as provided by Subdivision (3), Subsection (a),
2-26 Section 107.002, Civil Practice and Remedies Code.
