CONCURRENT RESOLUTION
1-1 WHEREAS, Cyral and Patricia Farley allege that just as
1-2 several property owners prevailed in Brainard v. State, 12 S.W.3d 6
1-3 (Tex. 1999), Cyral and Patricia Farley are the rightful owners of
1-4 the following real property and premises, extending to the banks of
1-5 the Canadian River, located in Hutchinson County, Texas:
1-6 (a) All of Section 55, Block 46, H.&T.C. RR Survey,
1-7 Hutchinson County, Texas, save and except:
1-8 A 44.7 acre tract in Section 55, Block 46, H&TC RR
1-9 Survey, Hutchinson County, Texas. Said tract being
1-10 more particularly described as follows:
1-11 Beginning at a 1 1/4 inch rod marking the southeast
1-12 corner of said Section 55;
1-13 Thence N 89 47' 14" W along the south line of said
1-14 Section 55 a distance of 2638.0 feet;
1-15 Thence N 1 21' E along a barbed wire fence a distance
1-16 of 48.7 feet;
1-17 Thence 62 34' E along a barbed wire fence a distance
1-18 of 2930.2 feet;
1-19 Thence N 61 42' E along a barbed wire fence a distance
1-20 of 47.1 feet;
1-21 Thence S 0 12' 46" W along the east line of said
1-22 Section 55 a distance of 1430.7 feet to the point of
1-23 beginning.
1-24 (b) All of Sections 56, 57, 58, 59 and 60, all in Block 46,
2-1 H.&T.C. Ry. Co. Survey; and
2-2 (c) All of the following property situated in block 47, H&TC
2-3 Ry. Co. Survey,

2-16 WHEREAS, Cyral and Patricia Farley seek to establish their
2-17 right to possession of and good and marketable title to the above
2-18 referenced property; now, therefore, be it
2-19 RESOLVED by the Legislature of the State of Texas, That Cyral
2-20 and Patricia Farley are granted permission to sue the State of
2-21 Texas and the General Land Office subject to Chapter 107, Civil
2-22 Practice and Remedies Code; and, be it further
2-23 RESOLVED, That the commissioner of the General Land Office be
2-24 served process as provided by Section 107.002(a)(3), Civil Practice
2-25 and Remedies Code.
