                                 A JOINT RESOLUTION
 1-1     proposing a constitutional amendment to abolish the office of
 1-2     justice of the peace in McMullen County.
 1-3           BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Section 18, Article V, Texas Constitution, is
 1-5     amended by adding Subsection (h) to read as follows:
 1-6           (h)  The office of Justice of the Peace in McMullen County is
 1-7     abolished.  The functions of the office are transferred to the
 1-8     judge of the County Court of McMullen County.  However, the office
 1-9     of Justice of the Peace is abolished under this subsection only if,
1-10     at the statewide election at which the constitutional amendment
1-11     providing for the abolition of the office in McMullen County is
1-12     submitted to and approved by the voters, a majority of the voters
1-13     of McMullen County voting on the question at that election also
1-14     favor the amendment.
1-15           SECTION 2.  The following temporary provision is added to the
1-16     Texas Constitution:
1-17           TEMPORARY PROVISION.  The abolition of the office of Justice
1-18     of the Peace in McMullen County under the constitutional amendment
1-19     proposed by the 77th Legislature, Regular Session, 2001, providing
1-20     for the abolition of the office in that county takes effect January
1-21     1, 2002, if the conditions of Section 18(h), Article V, as added by
1-22     that constitutional amendment, are met. This provision expires
1-23     January 2, 2002.
1-24           SECTION 3.  This proposed constitutional amendment shall be
 2-1     submitted to the voters at an election to be held on November 6,
 2-2     2001.  The ballot shall be printed to permit voting for or against
 2-3     the proposition: "The constitutional amendment providing for the
 2-4     abolition of the office of justice of the peace in McMullen
 2-5     County."
