                                 A JOINT RESOLUTION
 1-1     proposing a constitutional amendment relating to a moratorium on
 1-2     the execution of persons convicted of capital offenses.
 1-3           BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Section 11, Article IV, Texas Constitution, is
 1-5     amended by adding Subsection (c) to read as follows:
 1-6           (c)  The Texas Department of Criminal Justice is prohibited
 1-7     from performing executions until September 1, 2003, to permit an
 1-8     entity created by the 77th Legislature, Regular Session, 2001, to
 1-9     complete and present to the 78th Legislature, Regular Session,
1-10     2003, any studies on the administration of capital punishment in
1-11     this state required by the legislature and any recommended
1-12     legislation to improve procedures in capital cases.  This
1-13     subsection expires September 2, 2003.
1-14           SECTION 2. This proposed amendment shall be submitted to the
1-15     voters at an election to be held November 6, 2001.  The ballot
1-16     shall be printed to permit voting for or against the proposition:
1-17     "The constitutional amendment establishing a moratorium on the
1-18     execution of persons convicted of  capital offenses."
