By: Carona S.J.R. No. 26 1-1 SENATE JOINT RESOLUTION 1-2 proposing a constitutional amendment to remove the prohibition 1-3 against perpetual trusts. 1-4 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Section 26, Article I, Texas Constitution, is 1-6 amended to read as follows: 1-7 Sec. 26. Perpetuities and monopolies are contrary to the 1-8 genius of a free government, and shall never be allowed, nor shall 1-9 the law of primogeniture or entailments ever be in force in this 1-10 State. This section does not apply to trusts. 1-11 SECTION 2. This proposed constitutional amendment shall be 1-12 submitted to the voters at an election to be held November 6, 2001. 1-13 The ballot shall be printed to permit voting for or against the 1-14 proposition: "The constitutional amendment removing the 1-15 prohibition against perpetual trusts."
