1-1 SENATE JOINT RESOLUTION 1-2 proposing a constitutional amendment to promote uniformity in the 1-3 collection, deposit, reporting, and remitting of civil and criminal 1-4 fees. 1-5 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-6 SECTION 1. Article III, Texas Constitution, is amended by 1-7 adding Section 46 to read as follows: 1-8 Sec. 46. (a) In this section, "fee" means a fee in a 1-9 criminal or civil matter all or a portion of which is required to 1-10 be collected by local officers, clerks, or other local personnel 1-11 and remitted to the comptroller of public accounts for deposit in 1-12 the manner provided for in the law imposing the fee. 1-13 (b) This section applies only if the legislature enacts by 1-14 law a program to consolidate and standardize the collection, 1-15 deposit, reporting, and remitting of fees. 1-16 (c) A fee imposed by the legislature after the enactment of 1-17 the program described by Subsection (b) of this section is valid 1-18 only if the requirements relating to its collection, deposit, 1-19 reporting, and remitting conform to the program. 1-20 (d) A fee to which this section applies may take effect on a 1-21 date before the next January 1 after the regular session at which 1-22 the bill adopting the fee was enacted only if the bill is passed by 1-23 a record vote of two-thirds of all the members elected to each 1-24 house of the legislature on final consideration in each house. 1-25 SECTION 2. This proposed constitutional amendment shall be 2-1 submitted to the voters at an election to be held November 6, 2001. 2-2 The ballot shall be printed to permit voting for or against the 2-3 proposition: "The constitutional amendment to promote uniformity 2-4 in the collection, deposit, reporting, and remitting of civil and 2-5 criminal fees." _______________________________ _______________________________ President of the Senate Speaker of the House I hereby certify that S.J.R.
