                                 A JOINT RESOLUTION
 1-1     proposing a constitutional amendment to promote uniformity in the
 1-2     collection, deposit, reporting, and remitting of civil and criminal
 1-3     fees.
 1-4           BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Article III, Texas Constitution, is amended by
 1-6     adding Section 46 to read as follows:
 1-7           Sec. 46.  (a)  In this section, "fee" means a fee in a
 1-8     criminal or civil matter all or a portion of which is required to
 1-9     be collected by local officers, clerks, or other local personnel
1-10     and remitted to the comptroller of public accounts for deposit in
1-11     the manner provided for in the law imposing the fee.
1-12           (b)  This section applies only if the legislature enacts by
1-13     law a program to consolidate and standardize the collection,
1-14     deposit, reporting, and remitting of fees.
1-15           (c)  A fee imposed by the legislature after the enactment of
1-16     the program described by Subsection (b) of this section is valid
1-17     only if the requirements relating to its collection, deposit,
1-18     reporting, and remitting conform to the program.
1-19           SECTION 2.  This proposed constitutional amendment shall be
1-20     submitted to the voters at an election to be held November 6, 2001.
1-21     The ballot shall be printed to permit voting for or against the
1-22     proposition:  "The constitutional amendment to promote uniformity
1-23     in the collection, deposit, reporting, and remitting of civil and
1-24     criminal fees."
