                                  SENATE RESOLUTION
 1-1           BE IT RESOLVED by the Senate of the State of Texas, 77th
 1-2     Legislature, Regular Session, 2001, That Senate Rule 12.03 is
 1-3     suspended, as provided by Senate Rule 12.08, to enable the
 1-4     conference committee appointed to resolve the differences on Senate
 1-5     Bill No. 65, relating to the regulation of telepharmacy as a method
 1-6     to dispense drugs, to consider and take action on the following
 1-7     matter:
 1-8           Senate Rule 12.03(4) is suspended to permit the committee to
 1-9     add text on a matter that is not included in either the house or
1-10     senate version of the bill, to read as follows:
1-11           SECTION 4.  Subsection (a), Section 58.253, Utilities Code,
1-12     is amended to read as follows:
1-13           (a)  On customer request, an electing company shall provide
1-14     private network services to:
1-15                 (1)  an educational institution;
1-16                 (2)  a library;
1-17                 (3)  a nonprofit telemedicine center;
1-18                 (4)  a public or not-for-profit hospital;
1-19                 (5)  a project funded by the telecommunications
1-20     infrastructure fund under Subchapter C, Chapter 57, except for a
1-21     telepharmacy system; or
1-22                 (6)  a legally constituted consortium or group of
1-23     entities listed in this subsection.
1-24           Explanation:  This change is necessary to provide an
1-25     exception to the provision of private network services.
