No. 1259 SENATE RESOLUTION 1-1 BE IT RESOLVED by the Senate of the State of Texas, 77th 1-2 Legislature, Regular Session, 2001, That Senate Rule 12.03 be 1-3 suspended in part as provided by Senate Rule 12.08 to enable the 1-4 conference committee appointed to resolve the differences on Senate 1-5 Bill No. 1839, relating to certain long-term care facilities, to 1-6 consider and take action on the following matter: 1-7 Senate Rule 12.03(4) is suspended to permit the committee to 1-8 add a new subsection to added Section 242.037, Health and Safety 1-9 Code, to read as follows: 1-10 (d) For an institution that is owned and operated by a 1-11 governmental unit, as that term is defined by Section 101.001, 1-12 Civil Practice and Remedies Code, the insurance coverage maintained 1-13 by the institution must provide coverage only to the extent of the 1-14 governmental unit's liability under Section 101.023, Civil Practice 1-15 and Remedies Code. 1-16 Explanation: This change is necessary to clarify the amount 1-17 of coverage to be maintained by institutions owned and operated by 1-18 certain governmental units. 1-19 ______________________________________ 1-20 President of the Senate 1-21 I hereby certify that the above 1-22 Resolution was adopted by the Senate 1-23 on May 27, 2001, by the following 1-24 vote: Yeas 30, Nays 0, one present 1-25 not voting. 1-26 ______________________________________ 1-27 Secretary of the Senate
