Local Government Impact
The bill establishes a formula for adjusting the required minimum salary
for individuals whose contracts involve days of service in excess of
those required under the statutory definition of a 10-month contract.
Prior to a major recodification of the Education Code by the 74th Texas
Legislature in 1995, the Education Code contained a similar provision
concerning pay for days in excess of the minimum required under a
10-month contract. Although the Education Code does not currently
contain such a provision, the Texas Education Agency has indicated that
most districts continue to compute and pay teacher salaries with
consideration for any extra days duty required. Because the practice of
paying prorated salary amounts for extra days is widespread, although
not necessarily uniform, it is assumed that this provision would not
have a significant fiscal impact statewide among local school districts.
