LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE, 77th Regular Session April 27, 2001 TO: Honorable Juan Hinojosa, Chair, House Committee on Criminal Jurisprudence FROM: John Keel, Director, Legislative Budget Board IN RE: HB1028 by Wilson (Relating to the penalty for the possession of marihuana.), Committee Report 1st House, Substituted ************************************************************************** * No significant fiscal implication to the State is anticipated. * ************************************************************************** The bill would amend the Health and Safety Code by reducing the punishment of the offense of possession of marihuana from a Class B misdemeanor to a Class C misdemeanor if the amount of marihuana possessed is two ounces or less. The bill would also require as a condition of community supervision that offenders with three or more convictions within a two-year period attend education programs specified by a judge or a corrections department officer.
