The bill would amend the Health and Safety Code by reducing the
punishment of the offense of possession of marihuana from a Class B
misdemeanor to a Class C misdemeanor if the amount of marihuana
possessed is two ounces or less. The bill would also require as a
condition of community supervision that offenders with three or more
convictions within a two-year period attend education programs specified
by a judge or a corrections department officer.
Local Government Impact
No significant fiscal implication to units of local government is
anticipated.
