LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE, 77th Regular Session February 12, 2001 TO: Honorable Juan Hinojosa, Chair, House Committee on Criminal Jurisprudence FROM: John Keel, Director, Legislative Budget Board IN RE: HB1405 by Hupp (Relating to criminal and civil liability for causing injury to a pregnant woman.), As Introduced ************************************************************************** * No significant fiscal implication to the State is anticipated. * ************************************************************************** The bill would amend the Penal Code by making the offense of assault punishable as a felony of the third degree if a person intentionally, knowingly, or recklessly causes bodily injury to a pregnant woman. The bill would also amend the Penal Code by making the offense of aggravated assault punishable as a felony of the second degree if a person causes bodily injury causing a woman to suffer a miscarriage or stillbirth. The offense of intoxication assault would also be punishable as a felony of the second degree if the action results in bodily injury to another who is a pregnant woman and causes her to suffer a miscarriage or stillbirth.
