Local Government Impact
The bill would prohibit a municipality and a county from both regulating
a subdivision located in a municipality's extraterritorial jurisdiction
(ETJ). The municipality and county, on or before September 1, 2002,
would be required to enter into a written agreement that would identify
which governmental entity would be authorized to regulate subdivision
plats and approve related permits in the ETJ. Until an agreement is
reached, the municipality would regulate plats and permits within the ETJ
and the county would regulate the subdivisions outside the ETJ.
No significant fiscal implication to units of local government is
anticipated.
