Local Government Impact
The bill would provide that a municipality may regulate certain
subdivisions in the municipality's extraterritorial jurisdiction (ETJ)
located wholly in the municipality's annexation plan if the subdivision
was included in the plan at the time the plat was filed. Additionally, a
county would be allowed to regulate subdivisions only if all or part of
the subdivision was not included in the municipality's annexation plan at
the time the application for the plat was filed.
Under current law, both the county and the city review subdivision plats
in the city's ETJ and the more stringent standards of the two apply to
regulation of the development. The proposed change in statute would
dispense with dual review.
No significant fiscal implication to units of local government is
anticipated.
