LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE, 77th Regular Session April 11, 2001 TO: Honorable Patricia Gray, Chair, House Committee on Public Health FROM: John Keel, Director, Legislative Budget Board IN RE: HB1887 by Janek (Relating to the rights of patients receiving mental health services.), As Introduced ************************************************************************** * No significant fiscal implication to the State is anticipated. * ************************************************************************** The bill would add a subchapter to the Mental Health Code which allows persons who have had commitment proceedings initiated (but no final order) to consent to voluntary inpatient services and prohibits persons who have converted to a voluntary status to consent to participation in research programs. The bill assumes that once commitment proceedings are initiated a person lacks capacity to consent to certain actions.
