The bill would add a subchapter to the Mental Health Code which allows
persons who have had commitment proceedings initiated (but no final
order) to consent to voluntary inpatient services and prohibits persons
who have converted to a voluntary status to consent to participation in
research programs. The bill assumes that once commitment proceedings
are initiated a person lacks capacity to consent to certain actions.
Local Government Impact
No significant fiscal implication to units of local government is
anticipated.
