"Pete" Laney, Speaker of the House, House of Representatives FROM: John Keel, Director, Legislative Budget Board IN RE: HB2098 by Morrison (relating to the punishment for the offense of unlawful restraint.), As Passed 2nd House ************************************************************************** * No significant fiscal implication to the State is anticipated. * ************************************************************************** The bill would amend the Penal Code by making the offense of unlawful restraint punishable as a felony of the third degree if the actor restrains an individual the actor knows is a public servant while the public servant is lawfully discharging an official duty or in retaliation for the exercise of official duty of a public servant, or if the actor while in custody restrained any other person.
