The bill would amend the Penal Code by defining an "Elderly individual"
as a person 60 years of age or older, rather than the current definition
which is a person 65 years of age or older. The bill would also include
employees of licensed nursing facilities, assisted living facilities,
and intermediate care facilities under the offense of injury to a child,
elderly individual, or disabled individual. The bill would enhance the
punishment for the offense of injury to a child, elderly individual or
disabled individual to the next highest penalty grade depending on
whether the conduct was engaged in intentionally or knowingly,
recklessly, or as an act of criminal negligence.

Local Government Impact

No significant fiscal implication to units of local government is
anticipated.
