Bosse, Chair, House Committee on Civil Practices FROM: John Keel, Director, Legislative Budget Board IN RE: HB2225 by Davis, John (Relating to the amount of exemplary damages that may be awarded in actions involving injury to an elderly individual or a disabled individual.), As Introduced ************************************************************************** * No significant fiscal implication to the State is anticipated. * ************************************************************************** This bill amends 41.008, Civil Practice and Remedies Code, to establish a cap on exemplary damages that may be awarded in actions involving injury to an elderly or disabled individual. Under current law, the general cap on exemplary damages does not apply to a cause of action based on conduct described as a felony in 22.04, Penal Code, as that section applies to injury to an elderly or disabled individual. This bill would take effect September 1, 2001, and would apply only to an action filed on or after that date.
