Fiscal Analysis
The bill would require the Commission on Human Rights to review the
administration of tests used by fire departments and law enforcement
agencies, including state agencies and local governments, to determine
whether the tests are administered in a manner that does not discriminate
on the basis of race, color, disability, religion, sex, national origin,
or age unless the discrimination is a result of a bona fide occupational
qualification.
The Commission would be required to establish by rule how it will select
the agencies for review and the timetable for reviews.
State agencies and local governments would be required to revise the
administration of their essential job function tests to comply with
Commission recommendations.
Methodology
Enactment of the bill would result in additional costs to the Commission
on Human Rights of $132,122 per year and require an additional two FTEs.
This estimate is based on the assumption that the Commission would
perform 30 reviews of fire department and law enforcement agencies per
year and that each FTE would complete 15 reviews per year.
Local Government Impact
No significant fiscal implication to units of local government is
anticipated.
