Local Government Impact
The bill would authorize counties to enact ordinances to protect the
public health, safety, or welfare. A violation of the ordinances would be
a Class C misdemeanor for the first offense and a Class B misdemeanor
for a subsequent conviction. The county could receive injunctive relief
to prevent a violation or threatened violation. If an ordinance were to
conflict with a municipal ordinance in a municipality within the county,
the municipal ordinance would prevail within the municipality.
No significant fiscal implication to units of local government is
anticipated.
