LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE, 77th Regular Session May 11, 2001 TO: Honorable Mike Moncrief, Chair, Senate Committee on Health & Human Services FROM: John Keel, Director, Legislative Budget Board IN RE: HB3152 by Capelo (Relating to due process for physicians, dentists, and podiatrists in hospitals.), As Engrossed ************************************************************************** * No significant fiscal implication to the State is anticipated. * ************************************************************************** The bill would provide for a physician, podiatrist, or dentist who is damaged by a failure of a hospital to provide due process in considering applications for medical staff membership and privileges, renewal, modification, or revocation of privileges for a period of longer than 30 days to request that the hospital participate in alternative dispute resolution procedures or binding arbitration. While the hospital would not have to agree to participate in alternative dispute resolution procedures, the hospital would be required to participate in binding arbitration, if requested. The provisions of the bill would not authorize the physician, podiatrist, or dentist to take any other cause of action against the hospital.
