The bill would provide for a physician, podiatrist, or dentist who is
damaged by a failure of a hospital to provide due process in considering
applications for medical staff membership and privileges, renewal,
modification, or revocation of privileges for a period of longer than 30
days to request that the hospital participate in alternative dispute
resolution procedures or binding arbitration. While the hospital would
not have to agree to participate in alternative dispute resolution
procedures, the hospital would be required to participate in binding
arbitration, if requested. The provisions of the bill would not
authorize the physician, podiatrist, or dentist to take any other cause
of action against the hospital.

Local Government Impact

No significant fiscal implication to units of local government is
anticipated.
