Fiscal Analysis
The bill would amend, Chapter 103, Human Resources Code, Adult Day Care
Facilities, Chapter 242, Texas Health and Safety Code, Nursing
Facilities, and Chapter 252, Texas Health and Safety Code, ICF/MR
Facilities. The bill would require the Department of Human Services
(DHS) to adopt rules that set forth procedures for persons proposing to
construct or modify a facility. Submission of building plans for review
by the department of architectural requirements prior to beginning
construction and/or modifications would not be mandatory. Review and
notification to the requester of the review results must occur within 30
days from the date of submission of the plans. The bill allows the
department to charge a reasonable fee to cover costs with the proceeds
deposited to the General Revenue Fund.
Methodology
Implementation pursuant to provisions of the bill assumed an additional
nine staff in the first year, seven architects/engineers and two
administrative/technical support staff, and nine architects and two
support staff thereafter. Requests for reviews were assumed to be 168
the first year and 208 requests each subsequent year. The fee per
request was estimated by DHS to be $3,650. Estimates allow for the bill
requirement that reviews be completed within the 30 day time frame.
Local Government Impact
No fiscal implication to units of local government is anticipated.
