LEGISLATIVE BUDGET BOARD
Austin, Texas
FISCAL NOTE, 77th Regular Session
February 14, 2001
TO: Honorable Kenneth Armbrister, Chair, Senate Committee on
Criminal Justice
FROM: John Keel, Director, Legislative Budget Board
IN RE: SB107 by Barrientos (Relating to requiring sex offenders
released on community supervision, parole, or mandatory
supervision to maintain a certain distance from any
premises where children frequently gather.), As
Introduced
**************************************************************************
* No significant fiscal implication to the State is anticipated. *
**************************************************************************
The bill would amend the Government Code and the Code of Criminal
Procedure by requiring that sex offenders released on community
supervision, parole or mandatory supervision maintain a distance of at
least 1,000 feet from any premises where children frequently gather.
Currently, the distance must be that as either specified by the judge or
by the parole panel.
Local Government Impact
Although the fiscal impact of this bill is not likely to be significant
to units of local government, the bill could eventually have a fiscal
impact on local probation departments in their efforts to locate halfway
houses and other facilities for sex offenders. In fiscal year 2000,
there were 812 sex offenders placed on probation.
