Fiscal Analysis
  
The bill amends Chapter 37 of the Education Code by adding Section
37.0071.  The proposed section  requires school districts to ensure that
a student victim of conduct described by Section 37.007(a)(2) is not
assigned to the same campus, transportation route, or extracurricular
program as the student who committed the offense.  The action would be
required only if requested by a parent or other person with authority to
act on behalf of the student who was the victim of the conduct.  The bill
indicates that the separation could be requested regardless of where the
offense occurred.

The board of trustees would be authorized to determine if separate
assignments were practicable.  If the board of trustees of the school
district determined separate assignments were not practicable, the
student victim would be allowed to transfer to another district.  The
receiving district would be entitled to a 0.1 add-on for the student, as
under the Public Education Grant program.  If the receiving district
were not eligible to receive Tier II funding under the Foundation School
Program, the sending district would also be required to send an amount
equivalent to the Tier II revenue generated by the student.  Payments to
the receiving district would be prorated for the portion of the school
year the student attends in the receiving district.  The receiving
district would be prohibited from charging additional tuition for the
student.
  
  
Methodology
  
Based on data from the Texas Juvenile Probation Commission and public
school data, the Texas Education Agency projects that transfer
arrangements could be necessary for up to 731 students in the 2001-02
school year. It is assumed that each year another 731 first time transfer
arrangements could be necessary and a percentage of transfers from the
previous year would continue.

The combined Tiers 1 and 2 cost per student of the added 0.1 allotment is
estimated to be about $420.
  
  
Local Government Impact
  
If the board of trustees of the school district determined separate
assignments were not practicable, the student victim would be allowed to
transfer to another district.  The receiving district would be entitled
to a 0.1 add-on for the student, as under the Public Education Grant
program, as reflected in the state cost table above. The receiving
district would be prohibited from charging any additional tuition for the
student.

The bill also makes a provision for the sending district to provide an
amount equal to Tier II revenue computed in the manner provided under
Education Code, Section 37.0061 to the receiving district.
