IN RE: SB333 by Moncrief (Relating to the state child health
plan for certain low-income children.), Committee Report
               2nd House, as amended

The bill would authorize the Health and Human Services Commission to seek
a waiver under the Children's Health Insurance Program to cover adult
family members. Under current federal policy, states may not apply for
waivers unless three of several criteria are met, including the
elimination of an assets test for Medicaid eligibility for children, 12
months of continuous eligibility for children, eligibility simplification
for children, and presumptive eligibility for children. Under current
State policies, the State would not meet these criteria. Therefore, the
State would not be eligible under current policies for a waiver.

The bill would require that coverage under the state child health plan be
the secondary plan when coordinating benefits with other private
coverage. It is assumed there may be some savings to the State
associated with this provision but the savings are not anticipated to be
significant.

Local Government Impact
