         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on  
         Administration was held on Thursday, May 10, 2001, in E1.714.

         The Chair called the meeting to order at 4:05 p.m.  There being  
         a quorum present, the following business was transacted:   
          
         The Chair laid out SCR53 and recognized the author, Senator  
         Barrientos, to explain the bill.  Senator Cain moved that SCR53  
         be left pending to await a quorum; without objection, it was so  
         ordered.  Upon arrival of a quorum, Senator Ogden moved that  
         SCR53 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         record vote of 3 ayes, 0 nay, 0 present not voting, and 2  
         absent.  Senator Zaffirini moved that the bill be recommended  
         for placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.   
          
         At 4:15 p.m. Senator Zaffirini assumed the chair.   
          
         The Chair laid out HB2061 and recognized the Senate sponsor,  
         Senator Cain, to explain the bill.  Senator Cain moved that  
         HB2061 be reported favorably to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 3 ayes, 0 nay, 0 present not  
         voting, and 2 absent.   
          
         The Chair laid out HB2810 and recognized the Senate sponsor,  
         Senator Cain, to explain the bill.  Mark Brown, representing  
         Texas Legislative Council, testified on the bill.  The Chair  
         moved that the public testimony be closed; without objection, it  
         was so ordered.  Senator Cain moved that HB2810 be reported  
         favorably to the Senate with the recommendation that it do pass  
         and be printed.  The motion carried with a record vote of 3  
         ayes, 0 nay, 0 present not voting, and 2 absent.   
  
         The Chair laid out HB2812 and recognized the Senate sponsor,  
         Senator Cain, to explain the bill.  David Sharke, representing  
         Texas Legislative Council, testified on the bill.  The Chair  
         moved that the public testimony be closed; without objection, it  
         was so ordered.  Senator Cain moved that HB2812 be reported  
         favorably to the Senate with the recommendation that it do pass  
         and not be printed.  The motion carried with a record vote of 3  
         ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Cain  
         moved that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         The Chair laid out HCR41 and recognized the Senate sponsor,  
         Senator Armbrister, to explain the bill.  Senator Cain moved  
         that HCR41 be reported favorably to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 3 ayes, 0 nay, 0 present not  
         voting, and 2 absent.  Senator Cain moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         The Chair laid out HCR200 and recognized the Senate sponsor,  
         Senator Cain, to explain the bill.  Senator Cain moved that  
         HCR200 be reported favorably to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 3 ayes, 0 nay, 0 present not  
         voting, and 2 absent.  Senator Cain moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;

         The Chair laid out HB2813 and recognized the Senate sponsor,  
         Senator Cain, to explain the bill.  Shawn Harrison, representing  
         the Texas Legislative Council, registered as a resource witness  
         but did not testify.  The Chair moved that the public testimony  
         be closed; without objection, it was so ordered.  Senator Cain  
         moved that HB2813 be reported favorably to the Senate with the  
         recommendation that it do pass and not be printed.  The motion  
         carried with a record vote of 3 ayes, 0 nay, 0 present not  
         voting, and 2 absent.  Senator Cain moved that the bill be  
         recommended for placement on the Local and Uncontested Calendar;  
         without objection, it was so ordered.   
          
         The Chair laid out HB2811 and recognized the Senate sponsor,  
         Senator Cain, to explain the bill.  Deborah Fulton, representing  
         Texas Legislative Council, testified on the bill.  The Chair  
         moved that the public testimony be closed; without objection, it  
         was so ordered.  Senator Cain moved that HB2811 be reported  
         favorably to the Senate with the recommendation that it do pass  
         and not be printed.  The motion carried with a record vote of 3  
         ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Cain  
         moved that the bill be recommended for placement on the Local  
         and Uncontested Calendar; without objection, it was so ordered.   
          
         The Chair laid out HB2853 and recognized the Senate sponsor,  
         Senator Cain, to explain the bill.  Steve Collins, representing  
  
         Texas Legislative Council, testified on the bill. The Chair  
         moved that the public testimony be closed; without objection, it  
         was so ordered.  Senator Cain moved that HB2853 be left pending;  
         without objection, it was so ordered.   
          
         The Chair laid out HB2809 and recognized the Senate sponsor,  
         Senator Cain, to explain the bill.  J. Scott Morris,  
         representing himself, testified in opposition to the bill.   
         Steve Collins, representing Texas Legislative Council, testified  
         on the bill.  The Chair moved that the public testimony be  
         closed; without objection, it was so ordered.  Senator Cain  
         moved that HB2809 be left pending; without objection, it was so  
         ordered.   
          
         At 4:55 p.m. Senator Cain resumed the chair.   
          
         The chair laid out HCR255 and recognized Senator Ogden, in the  
         absence of the Senate sponsor, to explain the bill.   Senator  
         Ogden moved that HCR255 be reported favorably to the Senate with  
         the recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 3 ayes, 0 nay, 0 present not  
         voting, and 2 absent.  Senator Ogden moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         The Chair laid out HCR236 and recognized Senator Ogden, in the  
         absence of the Senate sponsor, to explain the bill.  Senator  
         Ogden moved that HCR236 be reported favorably to the Senate with  
         the recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 3 ayes, 0 nay, 0 present not

         The Chair laid out HCR227 and recognized Senator Ogden, in the

         the recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 3 ayes, 0 nay, 0 present not

         The Chair laid out HB 1056 and recognized Senator Ogden, in the  
         absence of the Senate sponsor, to explain the bill. Senator  
         Ogden moved that HB1056 be left pending; without objection, it  
         was so ordered.   
          
         The Chair laid out HCR241 and recognized Senator Ogden, in the  
         absence of the Senate sponsor, to explain the bill. Senator  
         Zaffirini moved that HCR241 be left pending; without objection,  
         it was so ordered.   
          
         Chairman Cain asked if there were any questions or comments  
         about any of the bills recommended for the May 15, 2001, Local  
  
         and Uncontested Calendar.  There was discussion.  Senator Cain  
         moved that all bills on page one of the Local and Uncontested  
         Calendar recommended list be certified with the exception of SB  
         1128 and SB 1414; without objection, it was so ordered  Senator  
         Ogden moved that all bills on page two of the Local and  
         Uncontested Calendar recommended list be certified; without  
         objection, it was so ordered.  Senator Ogden moved that all  
         bills on page three of the Local and Uncontested Calendar  
         recommended list be certified with the exception of HB 651;  
         without objection, it was so ordered.  Senator Zaffirini moved  
         that all bills on page four of the Local and Uncontested  
         Calendar recommended list be certified with the exception of HB  
         1782; without objection, it was so ordered.  Senator Ogden moved  
         that all bills on page five of the Local and Uncontested  
         Calendar recommended list be certified with the exception of HB  
         2255, HB 2384, HB 2432, HB 2585, and HB 2601; without objection,  
         it was so ordered.  Senator Zaffirini moved that all bills on  
         page six of the Local and Uncontested Calendar recommended list  
         be certified with the exception of HB 2817 and HB 2877; without  
         objection, it was so ordered.  Senator Ogden moved that all  
         bills on page seven of the Local and Uncontested Calendar  
         recommended list be certified with the exception of HB 3355;  
         without objection, it was so ordered.  
          
         Senator Zaffirini moved adoption of the minutes from the  
         previous hearing held on May 7, 2001.   
          
         There being no further business, at 5:15 p.m. Senator Cain moved  
         that the Committee stand recessed subject to the call of the  
         Chair.  Without objection, it was so ordered.
