         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public joint hearing of the Senate Committee on  
         Business & Commerce and the House Committee on State Affairs was  
         held on Monday, February 5, 2001, in the Senate Chamber at  
         Austin, Texas.

         Chairman Sibley and Chairman Wolens called the meeting to order  
         at 2:41 p.m.  There being a quorum present for each committee,  
         the following business was transacted. 
          
         Both Senator Sibley and Representative Wolens gave opening  
         remarks to the committee regarding electric utility  
         restructuring in Texas.   
          
         Invited testimony was taken.  The following witnesses testified  
         on the issue of electric utility restructuring: 
          
         Chairman Pat Wood, III, representing the Public Utility  
         Commission of Texas, 
         Commissioner Judy Walsh, representing the Public Utility  
         Commission of Texas, 
         Tom Baker, representing Texas Utilities and the Association of  
         Electric Companies of Texas, 
         Tom Noel, representing the Electric Reliability Council of  
         Texas, 
         Lynn Lednicky, representing Dynegy, 
         Janee Briesemeister, representing Consumers Union, 
         Mark MacLeod, representing Environmental Defense. 
          
         At 8:10 p.m. Chairman Wolens moved that the committees stand  
         recessed until subject to call of the Chair.  Without objection,  
         it was so ordered.
