         Pursuant to a notice posted in accordance with Senate Rule 11.18, a public joint hearing of the Senate  
         Committee on Business & Commerce and the Senate subcommittee on Border Affairs was held on Tuesday,  
         February 20, 2001, in the Lt. Governor Committee Hearing Room, 2E.20, at Austin, Texas.

         Chairman Sibley and Chairman Lucio called the meeting to order at 9:05 a.m.  There being a quorum present,  
         the following business was transacted:   
          
         The chair laid out SB272, by Senator Carona, which was left pending from the last Business and Commerce  
         Committee meeting.  Witnesses testifying and registering on the bill are shown on the attached list.  Senator  
         Carona moved that SB272 be reported favorably to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 6 ayes, 1 nay, 0 present not voting, and 0 absent.   
          
         The chair laid out SB414, by Senator Madla, which was left pending from the last Business and Commerce  
         Committee meeting. Senator Van de Putte sent up Committee Amendment 1 and moved adoption; without  
         objection, it was so ordered.  Senator Van de Putte requested unanimous consent to incorporate the  
         committee amendment into a committee substitute; without objection, it was so ordered.  Senator Van de  
         Putte then moved that the committee substitute be adopted; without objection, it was so ordered.  Senator  
         Van de Putte moved that SB414 do not pass but that CSSB414 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 0 nay, 0  
         present not voting, and 0 absent.   
         The chair laid out SB433, by Senator Carona, which was left pending from the last Business and Commerce  
         Committee meeting.  Witnesses testifying and registering on the bill are shown on the attached list.  Senator  
         Carona sent up Committee Amendment 1 and moved adoption; without objection, it was so ordered.  Senator  
         Carona sent up Committee Amendment 2 and moved adoption; without objection, it was so ordered.  Senator  
         Carona requested unanimous consent to roll the amendments into a committee substitute; without objection, it  
         was so ordered.  Senator Carona then moved that the committee substitute be adopted; without objection, it  
         was so ordered.  Senator Carona moved that SB433 do not pass but that CSSB433 be reported back to the  
         Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 7  
         ayes, 0 nay, 0 present not voting, and 0 absent.  Senator Carona moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without objection, it was so ordered.   
          
         The chair laid out SB466, by Senator Madla, which was left pending from the last Business and Commerce  
         Committee meeting.  Senator Van de Putte moved that SB466 be reported favorably to the Senate with the  
         recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 0 nay, 0  
  
         present not voting, and 0 absent.   
          
         The chair laid out SCR10 and recognized the author, Senator Shapleigh, to explain the resolution.  Witnesses  
         testifying and registering on the bill are shown on the attached list.  Senator Shapleigh moved that SCR10 be  
         reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried  
         with a record vote of 7 ayes, 0 nay, 0 present not voting, and 0 absent.   
          
         The chair laid out SB78 and recognized the author, Senator Haywood, to explain the bill.  Witnesses testifying  
         and registering on the bill are shown on the attached list.  Senator Fraser moved that SB78 be reported  
         favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a  
         record vote of 6 ayes, 0 nay, 0 present not voting, and 1 absent.  
          
         The chair laid out SB261 and recognized the author, Senator Bernsen, to explain the bill. Witnesses testifying  
         and registering on the bill are shown on the attached list.  Senator Jackson sent up a proposed committee  
         substitute.  Senator Sibley sent up Amendment 1 to the proposed committee substitute.  Senator Sibley  
         moved that Amendment 1 be adopted and rolled into a new committee substitute; without objection, it was so  
         ordered.  Senator Jackson moved that SB261 do not pass but that CSSB261 be reported back to the Senate  
         with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0  
         nay, 0 present not voting, and 1 absent.  Senator Lucio, Jr. moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without objection, it was so ordered. 
          
         At 9:55 a.m. Senator Lucio, Jr., Chairman of the Subcommittee on Border Affairs,  assumed the chair.   
         Senator Lucio, Jr., passed the gavel to Senator Shapleigh.   
          
         The Subcommittee on Border Affairs took up and considered SB 517.  Witnesses testifying and registering on  
         the bill in Subcommittee are shown on the attached list.  After a public hearing, the Subcommittee reported  
         CSSB 517 favorably to the Senate Committee on Business and Commerce. 
          
         At 10:39 p.m. Senator Sibley, Chairman of the Senate Business and Commerce Committee, resumed the  
         chair.  Senator Lucio, Jr. moved to suspend the 24 hour layout rule on subcommittee reports; without  
         objection, it was so ordered.  Senator Lucio, Jr. moved that the Subcommittee report on SB 517 be adopted;  
         without objection, it was so ordered.  Senator Lucio, Jr. moved that SB517 do not pass but that CSSB517 be  
         reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with  
         a record vote of 7 ayes, 0 nay, 0 present not voting, and 0 absent.   
          
         The chair laid out SB590 and recognized the author, Senator Jackson, to explain the bill.  Witnesses testifying  
         and registering on the bill are shown on the attached list.  Senator Jackson sent up a committee substitute;  
         without objection, it was so ordered.  Senator Jackson moved that SB590 do not pass but that CSSB590 be  
         reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with  
         a record vote of 7 ayes, 0 nay, 0 present not voting, and 0 absent.  Senator Jackson moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.   
          
         The chair laid out SCR25 and recognized the author, Senator Lucio, Jr., to explain the resolution.  Witnesses  
         testifying and registering on the bill are shown on the attached list.  Senator Lucio, Jr. moved that SCR25 be  
         reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried  
         with a record vote of 6 ayes, 0 nay, 0 present not voting, and 1 absent.      
          
         At 10:55 a.m. Senator Sibley moved that the committee stand recessed pending the call of the Chairman;  
         without objection, it was so ordered.
