         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Business &  
         Commerce was held on Tuesday, November 27, 2001, in the Capitol  
         Extension, Room E1.012, at Austin, Texas.

         The following members arrived after the roll was called:

         The chair called the meeting to order at 10:10 a.m.  There being  
         a quorum present, the following business was transacted:   
          
         Chairman Lucio gave opening remarks. 
          
         The first order of business was to adopt the subcommittee rules.   
         Without objection, the rules were adopted. 
          
         The Chair recognized the following witnesses: 
          
         Mr. Kris Heckmann, representing the Office of the Governor,  
         testified on the implementation of Proposition 2. 
          
         Acting Secretary of State Geoffrey Connor testified on the  
         implementation of Proposition 2. 
          
         Mr. Ignacio Madera, representing the Texas Water Development  
         Board, testified on the implementation of Proposition 2. 
          
         County Judge Gilberto Hinojosa, representing Cameron County,  
         testified on the implementation of Proposition 2. 
          
         Senator Sibley moved for the creation of the Border Colonia  
         Advisory Board, naming Hidalgo County Judge Eloy Pulido as  
         chair, El Paso County Commissioner Carlos Aguilar as vice-chair,  
         Cameron County Commissioner David Garza as a member, Zapata  
  
         County Commissioner Adolfo "Pope" Gonzalez as a member, and Webb  
         County Judge Mercurio Martinez, Jr as a member.  Without  
         objection, it was so ordered. 
          
         Mr. Micheal Behrens, representing the Texas Department of  
         Transportation, testified on the implementation of Proposition  
         2. 
          
         Mr. Kermit Black, representing the Texas A&M Center for Housing  
         and Urban Development, testified on the implementation of  
         Proposition 2. 
          
         Ms. Kim Edwards, representing the Texas Public Finance  
         Authority, testified on the implementation of Proposition 2.   
          
         Commissioner Carlos Aguilar, representing El Paso County,  
         testified on the implementation of Proposition 2. 
          
         County Judge Eloy Pulido, representing Hidalgo County, testified  
         on the implementation of Proposition 2. 
          
         Commissioner Sylvia Handy, representing Hidalgo County,  
         testified on the implementation of Proposition 2. 
          
         Mr. Jeff Moseley, representing the Texas Department of Economic  
         Development, testified on the interim charges. 
          
         Mr. Michael Behrens, representing the Texas Department of  
         Transportation, testified on the interim charges. 
          
         Mr. Rafael Vidaurri, representing Webb County, testified on the  
         implementation of Proposition 2. 
          
         County Judge Mike L. Fernandez, representing Val Verde County,  
         testified on the implementation of Proposition 2. 
          
         Chairman Lucio motioned for the addition of Val Verde County  
         Judge Mike L. Fernandez as a member of the Border Colonia  
         Advisory Board.  Without objection, it was so ordered. 
          
         County Judge Jerry Agan, representing Presidio County, testified  
         on the implementation of Proposition 2. 
          
         There being no further business, at 12:40 p.m., Chairman Lucio  
         moved that the subcommittee stand recessed subject to the call  
         of the Chair.  Without objection, it was so ordered.
