         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Education was  
         held on Wednesday, February 7, 2001, in the Capitol Extension  
         Auditorium at Austin, Texas.

         The chair called the meeting to order at 9:07 a.m.  There being  
         a quorum present, the following business was transacted:   
          
         The Committee held a joint hearing with the Special Commission  
         on 21st Century Colleges and Universities. 
          
         Opening remarks by Chairman Bivins and Chairman Adams. 
          
         John Opperman detailed the Commission's recommendations.  
          
         Invited testimony was taken;  witness list attached. 
          
         At 10:40 a.m. Senator Bivins moved that the committee stand  
         recessed until 1:00 p.m; without objection, it was so ordered. 
          
         At 1:04 p.m. the committee reconvened.   
          
         The chair laid out SB149 and recognized the author, Senator  
         Carona, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
         Bivins moved that SB149 be left pending to await a quorum;  
         without objection, it was so ordered.  Upon arrival of a quorum,  
         Senator Shapiro moved that SB149 be reported back to the Senate  
         with the recommendation that it do pass and be printed.  The  
         motion carried with a record vote of 7 ayes, 0 nay, 0 present  
  
         not voting, and 2 absent.  Senator Zaffirini moved that the bill  
         be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         Senator Nelson assumed the chair.  
          
         The chair laid out SB387 and recognized the author, Senator  
         Bivins, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
         Nelson moved that SB387 be left pending to await a quorum;  
         without objection, it was so ordered.  Upon arrival of a quorum,  
         Senator Bivins moved that SB387 be reported back to the Senate  
         with the recommendation that it do pass and be printed.  The  
         motion carried with a record vote of 7 ayes, 0 nay, 0 present  
         not voting, and 2 absent. Senator Bivins moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.    
          
         The chair laid out SB208 and recognized the author, Senator  
         Bivins, to explain the bill.  Witnesses testifying and

         without objection, it was so ordered.  Upon arrival of a quorum,  
         Senator Bivins moved that SB208 be reported back to the Senate

         The chair laid out SB206 and recognized the author, Senator  
         Bivins, to explain the bill.  Senator Bivins sent up a committee  
         substitute; the chair recognized Senator Bivins to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator Bivins moved adoption of the committee  
         substitute; without objection, it was so ordered.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  Senator Nelson moved that CSSB206 be left pending to  
         await a quorum; without objection, it was so ordered.  Senator  
         Bivins moved that SB206 do not pass but that CSSB206 be reported  
         back to the Senate with the recommendation that it do pass and  
         be printed.  The motion carried with a record vote of 7 ayes, 0  
         nay, 0 present not voting, and 2 absent.  Senator Bivins moved  
         that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         The chair laid out SB210 and recognized the author, Senator  
         Bivins, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
         Nelson moved that SB210 be left pending to await a quorum;  
         without objection, it was so ordered.  Upon arrival of a quorum,  
         Senator Bivins moved that SB210 be reported back to the Senate  
         with the recommendation that it do pass and be printed.  The

         The chair laid out SB209 and recognized the author, Senator  
         Bivins, to explain the bill.  Senator Nelson moved that SB209 be  
         left pending to await a quorum; without objection, it was so  
         ordered.  Upon arrival of a quorum, Senator Bivins moved that  
         SB209 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         record vote of 7 ayes, 0 nay, 0 present not voting, and 2  
         absent.  Senator Bivins moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.  
          
         There was no action taken for the following bill: SB 386 by  
         Bivins. 
          
         Senator Bivins resumed the chair.        
          
         The chair laid out SB82 and recognized Victoria Ford, in the  
         absence of the author, to explain the bill.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  Senator Bivins moved that SB82 be left pending to await a  
         quorum; without objection, it was so ordered.  Upon arrival of a  
         quorum, Senator Shapiro moved that SB82 be reported back to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a record vote of 7 ayes, 0 nay, 0  
         present not voting, and 2 absent.  Senator Van de Putte moved  
         that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.  
          
         The chair laid out SB71 and recognized the author, Senator  
         Haywood, to explain the bill.  Senator Truan moved that SB71 be  
         reported favorably to the Senate with the recommendation that it  
         do pass and be printed.  The motion carried with a record vote  
         of 7 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator  
         Truan moved that the bill be recommended for placement on the  
         Local & Uncontested Calendar; without objection, it was so  
         ordered.   
         The chair laid out SB72 and recognized the author, Senator  
         Haywood, to explain the bill.  Senator Cain moved that SB72 be  
         reported favorably to the Senate with the recommendation that it  
         do pass and be printed.  The motion carried with a record vote

         Senator Zaffirini moved adoption of the minutes from the  
         previous hearing held on January 24, 2001; without objection, it  
         was so ordered.

         Haywood, to explain the bill.  Senator Truan moved that SB73 be  
         reported favorably to the Senate with the recommendation that it  
  
         do pass and be printed.  The motion carried with a record vote

         Cain moved that the bill be recommended for placement on the  
         Local & Uncontested Calendar; without objection, it was so  
         ordered.

         Haywood, to explain the bill.  Senator Truan moved that SB74 be  
         reported favorably to the Senate with the recommendation that it  
         do pass and be printed.  The motion carried with a record vote

         Zaffirini moved that the bill be recommended for placement on  
         the Local & Uncontested Calendar; without objection, it was so  
         ordered.   
          
         The chair laid out SB77 and recognized the author, Senator  
         Haywood, to explain the bill.  Senator Shapiro moved that SB77  
         be reported favorably to the Senate with the recommendation that  
         it do pass and be printed.  The motion carried with a record  
         vote of 7 ayes, 0 nay, 0 present not voting, and 2 absent.   
         Senator Truan moved that the bill be recommended for placement  
         on the Local & Uncontested Calendar; without objection, it was  
         so ordered.   
          
         The chair laid out SB116 and recognized the author, Senator  
         Wentworth, to explain the bill.  Senator Zaffirini sent up a  
         committee substitute; the chair recognized Senator Wentworth to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Zaffirini moved adoption of the  
         committee substitute; without objection, it was so ordered.

         the attached list.  Senator Zaffirini moved that SB116 do not  
         pass but that CSSB116 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 7 ayes, 0 nay, 0 present not  
         voting, and 2 absent.   
          
         The chair laid out SJR2 and recognized the author, Senator  
         Wentworth, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
         Zaffirini moved that SJR2 be reported favorably to the Senate  
         with the recommendation that it do pass and be printed.  The  
         motion carried with a record vote of 7 ayes, 0 nay, 0 present  
         not voting, and 2 absent.    
          
         There being no further business, Senator Bivins moved that the  
         Committee stand recessed subject to the call of the chair.
