         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Education was  
         held on Wednesday, March 14, 2001, in the Capitol Extension,  
         Room E1.012, at Austin, Texas.

         The chair called the meeting to order at 9:05 a.m.  The  
         following business was transacted:   
          
         Senator Zaffirini assumed the chair.   
          
         The chair laid out SB940 and recognized the author, Senator  
         Bivins, along with Senator West, to explain the bill.  Senator  
         Bivins sent up a committee substitute; the chair recognized  
         Senator Bivins to explain the difference between the committee  
         substitute and the bill as filed.  Senator Bivins moved adoption  
         of the committee substitute; without objection, it was so  
         ordered.  Witnesses testifying and registering on the bill are  
         shown on the attached list.  Senator Bivins moved that SB940 do  
         not pass but that CSSB940 be reported back to the Senate with  
         the recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 7 ayes, 1 nay, 1 present not  
         voting, and 0 absent.   
          
         Senator Bivins resumed the chair.   
          
         The chair laid out SB108 and recognized the author, Senator  
         Lucio, Jr., to explain the bill.  Senator Van de Putte sent up a  
         committee substitute; the chair recognized Senator Lucio, Jr. to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Van de Putte moved adoption of the  
         committee substitute; without objection, it was so ordered.   
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  Senator Bivins moved that SB108 be left  
  
         pending to await a quorum; without objection, it was so ordered.   
         Upon arrival of a quorum, Senator Zaffirini moved that SB108 be  
         reported back to the Senate with the recommendation that it do  
         pass and be printed.  The motion carried with a record vote of 6  
         ayes, 0 nay, 1 present not voting, and 2 absent.   
          
         The chair laid out SB576 and recognized the author, Senator  
         West, to explain the bill.  Senator Zaffirini sent up a  
         committee substitute; the chair recognized Senator West to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Zaffirini moved adoption of the  
         committee substitute; without objection, it was so ordered.   
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  Senator Sibley sent up Committee Amendment 1  
         and moved adoption; without objection, the amendment was  
         adopted.  Senator Sibley requested unanimous consent to  
         incorporate amendments into the committee substitute; without  
         objection, it was so ordered.  Senator Zaffirini then moved that  
         the new committee substitute be adopted; without objection, it  
         was so ordered.  Senator Bivins moved that SB576 be left  
         pending; without objection, it was so ordered.   
          
         At 10:50 a.m. Senator Bivins moved that the committee stand  
         recessed until after adjournment of the Senate; without  
         objection, it was so ordered.   
          
         At 2:40 p.m. the committee reconvened.

         filed.  Senator Sibley moved adoption of the committee

         Zaffirini, to explain the bill.  Senator Zaffirini sent up  
         Committee Amendment 1 and moved adoption; without objection, the

         SB30 be left pending; without objection, it was so ordered.   
          
         The chair laid out SB216 and recognized the author, Senator  
         Bernsen, to explain the bill.  Senator Sibley sent up a  
         committee substitute; the chair recognized Senator Bernsen to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Sibley moved adoption of the committee  
         substitute; without objection, it was so ordered.  Witnesses

         CSSB216 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a

         placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.   
          
         The chair laid out SB562 and recognized the author, Senator  
         Shapiro, to explain the bill.  Senator Cain sent up a committee  
         substitute; the chair recognized Senator Shapiro to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator Cain moved adoption of the committee substitute;  
         without objection, it was so ordered.  Witnesses testifying and

         Shapiro moved that SB562 do not pass but that CSSB562 be  
         reported back to the Senate with the recommendation that it do

         reported back to the Senate with the recommendation that it do

         There was no action taken for the following bill(s): SB 460 by  
         Duncan 
          
         There being no further business, at 4:50 p.m. Senator Bivins  
         moved that the Committee stand recessed subject to the call of  
         the chair.  Without objection, it was so ordered.
