         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Education was  
         held on Wednesday, March 28, 2001, in the Capitol Extension,  
         Room E1.012, at Austin, Texas.

         The chair called the meeting to order at 9:10 a.m.  The  
         following business was transacted:   
          
         The chair laid out SB743 and recognized the author, Senator  
         Lucio, Jr., to explain the bill.  Senator Zaffirini sent up a  
         committee substitute; the chair recognized Senator Lucio, Jr. to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Zaffirini moved adoption of the  
         committee substitute; without objection, it was so ordered.   
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  Senator Zaffirini moved that SB743 do not  
         pass but that CSSB743 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 8 ayes, 0 nay, 0 present not  
         voting, and 1 absent.  Senator Truan moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         The chair laid out SB975 and recognized the author, Senator  
         Shapleigh, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
         Nelson moved that SB975 be reported favorably to the Senate with  
         the recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 8 ayes, 0 nay, 0 present not  
         voting, and 1 absent.   
         The chair laid out SB1205 and recognized the author, Senator  
  
         Jackson, to explain the bill.  Senator Nelson sent up a  
         committee substitute; the chair recognized Senator Jackson to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Nelson moved adoption of the committee  
         substitute; without objection, it was so ordered.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  Senator Truan moved that SB1205 do not pass but that  
         CSSB1205 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         record vote of 8 ayes, 0 nay, 0 present not voting, and 1  
         absent.   
          
         The chair laid out SB1498 and recognized the author, Senator  
         Harris, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
         Truan moved that SB1498 be reported favorably to the Senate with  
         the recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 8 ayes, 0 nay, 0 present not  
         voting, and 1 absent.  Senator Truan moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         The chair laid out SB19 and recognized the author, Senator  
         Nelson, to explain the bill.  Senator Nelson sent up a committee  
         substitute; the chair recognized Senator Nelson to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator Nelson moved adoption of the committee  
         substitute; without objection, it was so ordered.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  Senator Nelson moved that SB19 do not pass but that  
         CSSB19 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         record vote of 6 ayes, 0 nay, 0 present not voting, and 3  
         absent.  Senator Nelson moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.   
          
         Senator Zaffirini assumed the chair.   
          
         The chair laid out SB1196 and recognized the author, Senator  
         Truan, to explain the bill.  Senator Truan sent up a committee  
         substitute; the chair recognized Senator Truan to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator Truan moved adoption of the committee  
         substitute; without objection, it was so ordered.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.   
          
         At 10:45 a.m. Senator Zaffirini moved that the committee stand  
         recessed until after adjournment of the Senate; without  
         objection, it was so ordered.   
          
         At 4:10 p.m. the committee reconvened.   
          
         Senator Bivins resumed the chair.   
  
         Testimony resumed on CSSB 1196.  The chair moved that CSSB1196  
         be left pending to await a quorum; without objection, it was so  
         ordered.  Senator Truan sent up Committee Amendment 1 and moved  
         adoption; without objection, the amendment was adopted. Senator  
         Truan requested unanimous consent to incorporate amendments into  
         the committee substitute; without objection, it was so ordered.   
         Senator Truan then moved that the new committee substitute be  
         adopted; without objection, it was so ordered.  Senator Truan  
         moved that SB1196 do not pass but that CSSB1196 be reported back  
         to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 7 ayes, 0  
         nay, 0 present not voting, and 2 absent.    
          
         The chair laid out SB526 and recognized the author, Senator  
         Armbrister, to explain the bill.  Senator Shapiro sent up a  
         committee substitute; the chair recognized Senator Armbrister to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Shapiro moved adoption of the committee  
         substitute; without objection, it was so ordered.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  Senator Bivins moved that CSSB526 be left pending to  
         await a quorum; without objection, it was so ordered.  Upon  
         arrival of a quorum, Senator Shapiro moved to report CSSB 526  
         back to the Senate with the recommendation that it do pass and  
         be printed, the motion failed to receive a majority vote,  
         therefore, the bill remains pending in committee.   
          
         Senator Zaffirini assumed the chair.   
          
         The chair laid out SB26 and recognized the author, Senator  
         Shapiro, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
         Zaffirini moved that SB26 be left pending to await a quorum;  
         without objection, it was so ordered.  Upon arrival of a quorum,  
         Senator Shapiro moved that SB26 be reported back to the Senate  
         with the recommendation that it do pass and be printed.  The  
         motion carried with a record vote of 7 ayes, 0 nay, 0 present  
         not voting, and 2 absent.  Senator Shapiro moved that the bill  
         be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
         The chair laid out SB1327 and recognized the author, Senator  
         Bivins, to explain the bill.  Senator Bivins sent up a committee  
         substitute; the chair recognized Senator Bivins to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator Bivins moved adoption of the committee  
         substitute; without objection, it was so ordered.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  Senator Bivins moved that the committee reconsider the  
         motion by which the committee substitute was adopted.  Senator  
         Bivins sent up Committee Amendment 1 and moved adoption; without  
         objection, the amendment was adopted.  Senator Bivins requested  
         unanimous consent to incorporate amendments into the committee  
         substitute; without objection, it was so ordered.  Senator  
         Bivins then moved that the new committee substitute be adopted;  
  
         without objection, it was so ordered.  Senator Zaffirini moved  
         that CSSB1327 be left pending to await a quorum; without  
         objection, it was so ordered.  Senator Bivins moved that SB1327  
         do not pass but that CSSB1327 be reported back to the Senate  
         with the recommendation that it do pass and be printed.  The  
         motion carried with a record vote of 7 ayes, 0 nay, 0 present  
         not voting, and 2 absent.   
          
         The chair laid out SB1465 and recognized the author, Senator  
         Bivins, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
         Bivins sent up a committee substitute; the chair recognized  
         Senator Bivins to explain the difference between the committee  
         substitute and the bill as filed.  Senator Bivins moved adoption  
         of the committee substitute; without objection, it was so  
         ordered.  Senator Bivins moved that SB1465 be left pending;  
         without objection, it was so ordered.   
          
         Senator Zaffirini moved adoption of the minutes from the  
         previous hearings held on March 21, 2001, and March 26, 2001;  
         without objection, it was so ordered.   
          
         The chair laid out SB386 and recognized the author, Senator  
         Bivins, to explain the bill.  Senator Bivins sent up a committee  
         substitute; the chair recognized Senator Bivins to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator Bivins moved adoption of the committee  
         substitute; without objection, it was so ordered.  Senator  
         Bivins moved that SB386 do not pass but that CSSB386 be reported  
         back to the Senate with the recommendation that it do pass and

         Shapiro moved that SB460 be reported favorably to the Senate  
         with the recommendation that it do pass and be printed.  The  
         motion carried with a record vote of 6 ayes, 0 nay, 0 present  
         not voting, and 3 absent.   
          
         The chair laid out SB924 and recognized the author, Senator  
         Barrientos, to explain the bill.  Senator Truan moved that SB924  
         be reported favorably to the Senate with the recommendation that  
         it do pass and be printed.  The motion carried with a record  
         vote of 5 ayes, 1 nay, 0 present not voting, and 3 absent.   
          
         There was no action taken for the following bill(s):

         There being no further business, at 5:55 p.m. Senator Bivins  
         moved that the Committee stand recessed subject to the call of  
         the chair.  Without objection, it was so ordered.
