         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Education was  
         held on Wednesday, April 11, 2001, in the Capitol Extension,  
         Room E1.012, at Austin, Texas.

         The chair called the meeting to order at 9:11 a.m.  The  
         following business was transacted:   
          
         The chair laid out SB1432 and recognized the author, Senator  
         West, to explain the bill.  Senator Van de Putte sent up a  
         committee substitute; the chair recognized Senator West to  
         explain the difference between the committee substitute and the  
         bill as filed. Senator Van de Putte sent up Committee Amendment  
         1 and moved adoption; without objection, the amendment was  
         adopted.  Senator Van de Putte sent up Committee Amendment 2 and  
         moved adoption; without objection, the amendment was adopted.   
         Senator Van de Putte sent up Committee Amendment 3 and moved  
         adoption; without objection, the amendment was adopted.  Senator  
         Van de Putte sent up Committee Amendment 4 and moved adoption;  
         without objection, the amendment was adopted.  Senator Van de  
         Putte requested unanimous consent to incorporate amendments into  
         the committee substitute; without objection, it was so ordered.   
         Senator Van de Putte then moved that the new committee  
         substitute be adopted; without objection, it was so ordered.   
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  Senator Nelson moved that SB1432 do not pass  
         but that CSSB1432 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 8 ayes, 0 nay, 0 present not  
         voting, and 1 absent.   
          
         The chair laid out SB598 and recognized the author, Senator  
         Shapleigh, to explain the bill.  Senator Zaffirini sent up  
         Committee Amendment 1.  Witnesses testifying and registering on  
         the bill are shown on the attached list.  Senator Bivins moved  
         that SB598 be left pending; without objection, it was so  
         ordered.   
          
         At 9:53 a.m. Senator Bivins moved that the committee stand  
         recessed until after adjournment of the Senate; without  
         objection, it was so ordered.   
          
         At 12:35 p.m. the committee reconvened.   
          
         The chair laid out HB753 and recognized Senator Staples, in the  
         absence of the Senate sponsor, to explain the bill.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  Senator Bivins moved that HB753 be left pending to await  
         a quorum; without objection, it was so ordered.  Upon arrival of  
         a quorum, Senator Sibley moved that HB753 be reported back to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 8 ayes, 0  
         nay, 0 present not voting, and 1 absent.  Senator Sibley moved  
         that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         The chair laid out SB1625 and recognized Senator Staples, in the  
         absence of the author, to explain the bill.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  Senator Bivins moved that SB1625 be left pending to await  
         a quorum; without objection, it was so ordered.  Upon arrival of  
         a quorum, Senator Sibley moved that SB1625 be reported back to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 8 ayes, 0  
         nay, 0 present not voting, and 1 absent.  Senator Sibley moved  
         that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         The chair laid out SB1705 and recognized the author, Senator Van  
         de Putte, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
         Van de Putte sent up Committee Amendment 1 and moved adoption;  
         without objection, the amendment was adopted.  Senator Van de  
         Putte requested unanimous consent to incorporate amendments into  
         the committee substitute; without objection, it was so ordered.   
         Senator Van de Putte then moved that the new committee  
         substitute be adopted; without objection, it was so ordered.   
         Senator Van de Putte moved that SB1705 do not pass but that  
         CSSB1705 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         record vote of 8 ayes, 0 nay, 0 present not voting, and 1  
         absent.   
          
         The chair laid out SB978 and recognized the author, Senator  
         Lucio, Jr., to explain the bill.  Senator Truan sent up  
  
         Committee Amendment 1 and Senator Staples moved adoption;  
         without objection, the amendment was adopted.  Senator Truan  
         requested unanimous consent to roll the amendments into a  
         committee substitute; without objection, it was so ordered.   
         Senator Truan then moved that the committee substitute be  
         adopted; without objection, it was so ordered. Witnesses

         list.  Senator Bivins moved that CSSB978 be left pending;  
         without objection, it was so ordered.   
          
         The chair laid out SB1446 and recognized the author, Senator Van

         Truan moved that SB1446 be reported favorably to the Senate with  
         the recommendation that it do pass and be printed.  The motion

         be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.

         voting, and 1 absent.  Senator Staples moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.

         that SB526 do not pass but that CSSB526 be reported back to the  
         Senate with the recommendation that it do pass and be printed.

         present not voting, and 2 absent.   
          
         Senator Truan assumed the chair.   
          
         The chair laid out pending bill SB1466 and recognized the  
         author, Senator Bivins, to explain the bill.  Senator Bivins  
         moved that the previously adopted substitute be pulled down;   
         there being no objection, it was so ordered.  Senator Bivins  
         sent up a new committee substitute; the chair recognized Senator  
         Bivins to explain the difference between the committee  
         substitute and the bill as filed.  Senator Bivins moved adoption  
         of the committee substitute; without objection, it was so  
         ordered.  Senator Bivins moved that SB1466 do not pass but that  
         CSSB1466 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         record vote of 6 ayes, 1 nay, 0 present not voting, and 2  
         absent.   
          
         Senator Bivins resumed the chair.

         that SB1727 be reported favorably to the Senate with the

         The chair laid out HB1545 and recognized the Senate sponsor,  
         Senator Bivins, to explain the bill.  Senator Bivins sent up a  
         committee substitute; the chair recognized Senator Bivins to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Bivins moved adoption of the committee  
         substitute; without objection, it was so ordered.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  Senator Bivins moved that HB1545 do not pass but that  
         CSHB1545 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         record vote of 7 ayes, 0 nay, 0 present not voting, and 2  
         absent.   
          
         Senator Truan moved adoption of the minutes from the previous  
         hearings held on April 4, 2001, April 5, 2001, and April 9,  
         2001; without objection, it was so ordered.   
          
         The chair laid out pending bill SB914 and recognized the author,  
         Senator Ogden, to explain the bill. Senator Bivins laid out a  
         substitute for SB 914.  Senator Nelson sent up Committee  
         Amendment 1 and moved adoption; without objection, the amendment  
         was adopted.  Senator Nelson requested unanimous consent to  
         incorporate amendments into the committee substitute; without  
         objection, it was so ordered.  Senator Nelson then moved that  
         the new committee 
          
         substitute be adopted; without objection, it was so ordered.   
         Senator Staples moved that SB914 do not pass but that CSSB914 be  
         reported back to the Senate with the recommendation that it do  
         pass and be printed.  The motion carried with a record vote of 7  
         ayes, 0 nay, 0 present not voting, and 2 absent.
