         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Education was  
         held on Wednesday, April 18, 2001, in the Capitol Extension,  
         Room E1.012, at Austin, Texas.

         The chair called the meeting to order at 9:07 a.m.  The  
         following business was transacted:   
          
         The Committee began the meeting with discussion of  Witnesses  
         testifying and registering are shown on the attached list.   
          
         The chair laid out SB1525 and recognized the author, Senator Van  
         de Putte, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  At this  
         point the Committee recessed, therefore, on a motion by the  
         Chairman, the bill was left pending until the committee  
         reconvened.   When the bill was taken back up for consideration,  
         Senator Van de Putte sent up a committee substitute; the chair  
         recognized Senator Van de Putte to explain the difference  
         between the committee substitute and the bill as filed.  Senator  
         Van de Putte moved adoption of the committee substitute; without  
         objection, it was so ordered.  Senator Van de Putte moved that  
         SB599 do not pass but that CSSB599 be reported back to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a record vote of 8 ayes, 0 nay, 0  
         present not voting, and 1 absent.  Senator Van de Putte moved  
         that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         At 9:50 a.m. Senator Bivins moved that the committee stand  
         recessed until after adjournment of the Senate; without  
  
         objection, it was so ordered.   
          
         At 1:10 p.m. the committee reconvened.   
          
         The Committee heard testimony by representatives of the LBB  
         regarding the public school employee health insurance bill  
         draft. 
          
         The chair laid out SB1100 and recognized the author, Senator  
         Moncrief, to explain the bill.  Senator Zaffirini sent up a  
         committee substitute; the chair recognized Senator Moncrief to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Zaffirini moved adoption of the  
         committee substitute; without objection, it was so ordered.   
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  Senator Bivins moved that SB1100 be left  
         pending to await a quorum; without objection, it was so ordered.   
         Upon arrival of a quorum, Senator Truan moved that SB1100 do not  
         pass but that CSSB1100 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 8 ayes, 0 nay, 0 present not  
         voting, and 1 absent.   
          
         The chair laid out SB998 and recognized the author, Senator  
         Madla, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
         Bivins moved that SB998 be left pending to await a quorum;  
         without objection, it was so ordered.  Upon arrival of a quorum,  
         Senator Van de Putte moved that SB998 be reported back to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a record vote of 8 ayes, 0 nay, 0  
         present not voting, and 1 absent.  Senator Van de Putte moved  
         that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.

         West, to explain the bill.  Senator Van de Putte sent up a

         The chair laid out SB702 and recognized the author, Senator  
         West, to explain the bill.  Senator Sibley sent up a committee  
         substitute; the chair recognized Senator West to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator Sibley moved adoption of the committee

         The chair laid out SB1545 and recognized the author, Senator

         without objection, it was so ordered.  Upon arrival of a quorum,  
         Senator Staples moved that SB1545 be reported back to the Senate  
         with the recommendation that it do pass and be printed.  The  
         motion carried with a record vote of 7 ayes, 0 nay, 0 present  
         not voting, and 2 absent.  Senator Staples moved that the bill

         Senator Sibley, to explain the bill.  Senator Sibley sent up a

         moved that SB1726 be left pending to await a quorum; without  
         objection, it was so ordered.  Upon arrival of a quorum, Senator

         ordered.  The chair recalled SB 1728 and recognized Senator Cain  
         for a motion.  Senator Cain sent up a committee substitute; the  
         chair recognized Senator Cain to explain the difference between  
         the committee substitute and the bill as filed.  Senator Cain  
         moved adoption of the committee substitute; without objection,  
         it was so ordered.  Senator Bivins moved that SB1728 be left  
         pending to await a quorum; without objection, it was so ordered.   
         Upon arrival of a quorum, Senator Cain moved that SB1728 do not  
         pass but that CSSB1728 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 8 ayes, 0 nay, 0 present not  
         voting, and 1 absent.  Senator Cain moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         Senator Cain assumed the chair.   
          
         The chair laid out SB1461 and recognized Senator Bivins, in the  
         absence of the author, to explain the bill.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  The chair moved that SB1461 be left pending; without  
         objection, it was so ordered.   
          
         Senator Bivins resumed the chair.   
          
         The chair laid out SB1626 and recognized the author, Senator  
         Armbrister, to explain the bill.  Senator Cain sent up Committee  
         Amendment 1 and moved adoption; without objection, the amendment  
         was adopted.  Senator Cain requested unanimous consent to roll  
         the amendments into a committee substitute; without objection,  
         it was so ordered.  Senator Cain then moved that the committee  
         substitute be adopted; without objection, it was so ordered.

         pending to await a quorum; without objection, it was so ordered.

         carried with a record vote of 8 ayes, 0 nay, 0 present not  
         voting, and 1 absent.  Senator Truan moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
  
         without objection, it was so ordered.   
          
         The chair laid out SB599 and recognized the author, Senator  
         Shapleigh, to explain the bill.  Senator Sibley sent up a  
         committee substitute; the chair recognized Senator Shapleigh to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Sibley moved adoption of the committee  
         substitute; without objection, it was so ordered.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  Senator Bivins moved that SB599 be left pending to await  
         a quorum; without objection, it was so ordered.  Upon arrival of  
         a quorum, Senator Truan moved that SB599 do not pass but that  
         CSSB599 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         record vote of 8 ayes, 0 nay, 0 present not voting, and 1  
         absent.  Senator Truan moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.    
          
         Senator Truan moved adoption of the minutes from the previous  
         hearing held on April 11, 2001; without objection, it was so  
         ordered.   
          
         There being no further business, at 3:55 p.m. Senator Bivins  
         moved that the Committee stand recessed subject to the call of  
         the chair.  Without objection, it was so ordered.
