         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Finance was  
         held on Monday, May 7, 2001, in the Capitol Extension, Room  
         E1.028, at Austin, Texas.

         The chair called the meeting to order at 4:15 p.m.  There being  
         a quorum present, the following business was transacted:   
          
         At 4:15 p.m. Senator Ogden assumed the chair.   
          
         The chair laid out HB2852 and recognized the Senate sponsor,  
         Senator Ellis, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
         Ellis moved that HB2852 be reported favorably to the Senate with  
         the recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 12 ayes, 0 nay, 0 present not  
         voting, and 1 absent.  Senator Ellis moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         The chair laid out HB2190 and recognized the Senate sponsor,  
         Senator Ellis, to explain the bill.    Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
  
         Ellis moved that HB2190 be reported favorably to the Senate with  
         the recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 12 ayes, 0 nay, 0 present not  
         voting, and 1 absent.  Senator Ellis moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         At 4:25 p.m. Senator Truan assumed the chair.   
          
         The chair laid out HB1333 and recognized the Senate sponsor,  
         Senator Ellis, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
         Ellis sent up a committee substitute; the chair recognized  
         Senator Ellis to explain the difference between the committee  
         substitute and the bill as filed.  Senator Ellis moved adoption  
         of the committee substitute; without objection, it was so  
         ordered.  Senator Ellis requested unanimous consent to roll one  
         amendment into the committee substitute; without objection, it  
         was so ordered.  Senator Ellis then moved that the new committee  
         substitute be adopted; without objection, it was so ordered.   
         Senator Ellis moved that HB1333 do not pass but that CSHB1333 be  
         reported back to the Senate with the recommendation that it do  
         pass and be printed.  The motion carried with a record vote of  
         12 ayes, 0 nay, 0 present not voting, and 1 absent.   
          
         At 4:45 p.m. Senator Ellis assumed the chair.   
          
         The chair laid out HB3097 and recognized the Senate sponsor,  
         Senator Truan, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
         Ellis moved that HB3097 be left pending; without objection, it  
         was so ordered.   
          
         The chair laid out HJR82 and recognized the Senate sponsor,  
         Senator Truan, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
         Ellis moved that HJR82 be left pending; without objection, it  
         was so ordered.   
          
         The chair laid out HB2071 and recognized the Senate sponsor,  
         Senator Haywood, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  Senator  
         Haywood moved that HB2071 be reported favorably to the Senate  
         with the recommendation that it do pass and be printed.  The  
         motion carried with a record vote of 11 ayes, 0 nay, 1 present  
         not voting, and 1 absent.  Senator Ellis moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         The chair laid out SCR48 and recognized Senator Whitmire, in the  
  
         absence of the author, Senator Bivins, to explain the bill.

         pending; without objection, it was so ordered.

         Whitmire sent up a committee substitute; the chair recognized

         adoption of the committee substitute; without objection, it was  
         so ordered.  Senator Ellis moved that SCR42 be left pending;  
         without objection, it was so ordered.   
          
         At 4:55 p.m. Senator Whitmire assumed the chair.

         Ellis sent up a committee substitute; the chair recognized

         of the committee substitute; without objection, it was so  
         ordered.  Senator Ellis moved that HB3064 do not pass but that  
         CSHB3064 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         record vote of 11 ayes, 0 nay, 0 present not voting, and 2  
         absent.   
          
         The chair laid out HJR97 and recognized the Senate sponsor,  
         Senator Ellis, to explain the bill.  Witnesses testifying and

         Ellis sent up a committee substitute; the chair recognized  
         Senator Ellis to explain the difference between the committee  
         substitute and the bill as filed.  Senator Ellis moved adoption  
         of the committee substitute; without objection, it was so  
         ordered.  Senator Ellis moved that HJR97 do not pass but that  
         CSHJR97 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a

         The chair laid out SB1801 and recognized the author, Senator  
         Ogden, to explain the bill.  Witnesses testifying and

         Whitmire moved that SB1801 be left pending; without objection,  
         it was so ordered.   
          
         The chair laid out SCR39 and recognized Senator Lindsay, in the  
  
         absence of the author, Senator Van de Putte, to explain the  
         bill.  Witnesses testifying and registering on the bill are  
         shown on the attached list.  Senator Lindsay sent up a committee  
         substitute; the chair recognized Senator Armbrister to explain  
         the difference between the committee substitute and the bill as  
         filed.  Senator Lindsay moved adoption of the committee  
         substitute; without objection, it was so ordered.  Senator  
         Lindsay moved that SCR39 be left pending; without objection, it  
         was so ordered.   
          
         The posting rule, Senate Rule 11.18, was suspended to hear the  
         following bill:  
         The chair laid out HB1200 and recognized Senator Lucio, in the  
         absence of the Senate sponsor, Sentor Harris, to explain the  
         bill.  Witnesses testifying and registering on the bill are  
         shown on the attached list.   
         At 5:13 p.m. Senator Lindsay assumed the chair.  
         Senator Lucio, sent up Committee Amendment 1 and explained the  
         amendment.  Senator Lindsay moved that HB1200 be left pending;  
         without objection, it was so ordered.   
          
         The chair laid out HB2604 and recognized Senator Ogden, in the  
         absence of the Senate sponsor, Senator Duncan, to explain the  
         bill.  Witnesses testifying and registering on the bill are  
         shown on the attached list.  Senator Lindsay moved that HB2604  
         be left pending; without objection, it was so ordered.   
          
         At 6:15 p.m. Senator Ellis resumed the chair.   
          
         The chair laid out HB2378 and recognized the Senate sponsor,  
         Senator Armbrister, to explain the bill.  Witnesses testifying  
         and registering on the bill are shown on the attached list.   
         Senator Truan sent up a committee substitute; the chair  
         recognized Senator Armbrister to explain the difference between  
         the committee substitute and the bill as filed.  Senator Truan  
         moved adoption of the committee substitute; without objection,  
         it was so ordered.  Senator Truan moved that HB2378 do not pass  
         but that CSHB2378 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 13 ayes, 0 nay, 0 present not  
         voting, and 0 absent.  Senator Truan moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         There being no further business, at 6:45 p.m. Senator Ellis  
         moved that the Committee stand at ease until 8:00 a.m., May 8,  
         2001.  Without objection, it was so ordered.
