Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Senate Committee on Jurisprudence
was held on Monday, March 19, 2001, in the Capitol Extension,
Room E1.012, at Austin, Texas.

Senator David Bernsen, the acting chair, called the meeting to
order at 4:14 p.m. There being a quorum present, the following
business was transacted:
The following members arrived after the roll was called:

Senator Wentworth moved adoption of the minutes from the
previous hearing held on March 12, 2001; without objection, it
was so ordered.
The chair laid out SB769 and recognized the author, Senator
Harris, to explain the bill. There was no public testimony on
this bill.
The chair laid out SB774 and recognized the author, Senator
Harris, to explain the bill. There was no public testimony on
this bill.
At 4:24 p.m. Senator Wentworth assumed the chair.
The chair laid out SB720 and recognized Senator Bernsen, in the
absence of the author, to explain the bill. Witnesses
testifying and registering on the bill are shown on the attached
list. The chair moved that the public testimony be closed;
without objection, it was so ordered.
At 4:29 p.m. Senator Bernsen assumed the chair.

At 4:48 p.m. Senator Brown assumed the chair.
The chair laid out SB822 and recognized Senator Bernsen, in the
absence of the author, to explain the bill. Witnesses
testifying and registering on the bill are shown on the attached
list. The chair moved that the public testimony be closed;
without objection, it was so ordered.
The chair laid out SB823 and recognized Senator Bernsen, in the
absence of the author, to explain the bill. Witnesses
testifying and registering on the bill are shown on the attached
list. The chair moved that the public testimony be closed;

The chair laid out SB478 and recognized Senator Bernsen, in the
absence of the author, to explain the bill. Senator Bernsen
sent up a committee substitute; the chair recognized Senator
Bernsen to explain the difference between the committee
substitute and the bill as filed. Senator Bernsen moved
adoption of the committee substitute; without objection, it was
so ordered. Witnesses testifying and registering on the bill
are shown on the attached list. The chair moved that the public
testimony be closed; without objection, it was so ordered.
Senator Bernsen moved that the committee stand recessed until
5:45 p.m; without objection, it was so ordered.
At 6:01 p.m. Senator Wentworth assumed the chair.
The chair laid out SB1192 and recognized the author, Senator
West, to explain the bill. Witnesses testifying and registering

that the public testimony be closed; without objection, it was
so ordered.
At 8:39 p.m. Senator West assumed the chair.
There being no further business, at 8:45 p.m. Senator West moved
that the Committee stand recessed subject to the call of the
chair. Without objection, it was so ordered.
The Committee reconvened on Tuesday, March 20, 2001 upon
adjournment of the Senate.
Chairman West called the meeting to order at 1:25. There was a
quorum present.
At 1:26 p.m. Senator Bernsen assumed the chair.
Senator West moved that SB478 do not pass but that CSSB478 be
reported back to the Senate with the recommendation that it do
pass and be printed. The motion carried with a record vote of 6
ayes, 0 nay, 0 present not voting, and 1 absent.
At 1:27 p.m. Senator West resumed the chair.
Senator Bernsen moved that SB769 be reported favorably to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a record vote of 7 ayes, 0 nay, 0
present not voting, and 0 absent.
Senator Bersen moved adoption of the committee substitute to
SB774; without objection, it was so ordered. Senator Bernsen
moved that SB774 do not pass but that CSSB774 be reported back
to the Senate with the recommendation that it do pass and be
printed. The motion carried with a record vote of 6 ayes, 0
nay, 0 present not voting, and 1 absent.
There being no further business, at 1:29 p.m. Senator West moved
that the Committee stand recessed subject to the call of the
chair. Without objection, it was so ordered.
