         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Natural  
         Resources was held on Tuesday, May 1, 2001, in the Senate  
         Chamber at Austin, Texas.

         The Chair called the meeting to order at 2:19 p.m.  There being  
         a quorum present, the following business was transacted:   
          
         The Chair laid out HB651 and recognized the Senate sponsor,  
         Senator Haywood, to explain the bill.  Public testimony was  
         taken.  Witnesses testifying and registering on the bill are  
         shown on the attached list.  Public testimony was closed.  The  
         bill was left pending awaiting a quorum.  
          
         The Chair laid out HB2432 and recognized the Senate sponsor,  
         Senator Armbrister, to explain the bill.  Public testimony was  
         taken.  Witnesses testifying and registering on the bill are  
         shown on the attached list.  Public testimony was closed.  The  
         bill was left pending awaiting a quorum.   
          
         The Chair laid out SB1619 and SB1620 and recognized the Senate  
         sponsor, Senator Armbrister, to explain the bills.  Public  
         testimony was taken.  Witnesses testifying and registering on

         The Chair laid out HB1686 and recognized the Senate sponsor,

         The Chair laid out HB2959 and recognized the Senate sponsor,  
         Senator Ogden, to explain the bill.  Senator Barrientos sent up  
         a committee substitute; the Chair recognized Senator Ogden to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Barrientos moved adoption of the  
         committee substitute; without objection, it was so ordered.

         The Chair laid out HB266 and recognized the Senate sponsor,

         The Chair laid out HB1504 and recognized the Senate sponsor,  
         Senator Bivins, to explain the bill.  Public testimony was  
         closed.  Senator Bivins moved that HB1504 be reported favorably  
         to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 5 ayes, 0  
         nay, 0 present not voting, and 2 absent.  Senator Bivins moved  
         that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         The Chair again laid out HB651 and recognized the Senate  
         sponsor, Senator Haywood.  Senator Haywood sent up Committee  
         Amendment 1 and Senator Bivins moved adoption; without  
         objection, the amendment was adopted.  Senator Haywood moved  
         that HB651, as amended, be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 5 ayes, 0 nay, 0 present not  
         voting, and 2 absent.  Senator Bivins moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         Senator Barrientos moved that HB1686 be reported favorably to  
  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 5 ayes, 0  
         nay, 0 present not voting, and 2 absent.  Senator Barrientos  
         moved that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         Senator Haywood moved that HB2354 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a record vote of 5 ayes, 0 nay, 0  
         present not voting, and 2 absent.  Senator Haywood moved that  
         the bill be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         Senator Bivins moved that HB2959 do not pass but that CSHB2959  
         be reported back to the Senate with the recommendation that it  
         do pass and be printed.  The motion carried with a record vote  
         of 6 ayes, 0 nay, 0 present not voting, and 1 absent.  Senator  
         Bivins moved that the bill be recommended for placement on the  
         Local & Uncontested Calendar; without objection, it was so  
         ordered.   
          
         Senator Barrientos moved that HB3415 be reported favorably to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 6 ayes, 0  
         nay, 0 present not voting, and 1 absent.  Senator Barrientos  
         moved that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         Senator Bivins moved that SB1619 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a record vote of 6 ayes, 0 nay, 0  
         present not voting, and 1 absent.  Senator Bivins moved that the  
         bill be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered. 
          
         Senator Bivins moved that SB1620 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.

         Senator Barrientos moved that HB2432 be reported favorably to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 6 ayes, 0  
         nay, 0 present not voting, and 1 absent.  Senator Barrientos  
         moved that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         The Chair laid out HB2793 and SB1219 and recognized the Senate  
         sponsor of HB2793 and the author of SB1219, Senator Bernsen, to  
         explain the bills.  Public testimony was taken.  Witnesses

         The Chair laid out HB2572 and recognized the Senate sponsor,  
         Senator Staples, to explain the bill.  Senator Lucio sent up a  
         committee substitute; the Chair recognized Senator Staples to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Lucio moved adoption of the committee  
         substitute; without objection, it was so ordered.  Public

         Senator Brown, to explain the bill.  Senator Brown sent up  
         Committee Amendment 1 and moved adoption; without objection, the  
         amendment was adopted.  Pubic testimony was closed.  Senator  
         Brown moved that HB3286, as amended, be reported back to the  
         Senate with the recommendation that it do pass and be printed.

         Calendar; without objection, it was so ordered.   
          
         Senator Brown moved that HB1687 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.

         present not voting, and 1 absent.  Senator Brown moved that the  
         bill be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         Senator Brown moved that HB2572 do not pass but that CSHB2572 be  
         reported back to the Senate with the recommendation that it do  
         pass and be printed.  The motion carried with a record vote of 6  
         ayes, 0 nay, 0 present not voting, and 1 absent.  Senator Brown  
         moved that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         Senator Brown moved that HB2690 do not pass but that CSHB2690 be  
         reported back to the Senate with the recommendation that it do  
         pass and be printed.  The motion carried with a record vote of 6  
         ayes, 0 nay, 0 present not voting, and 1 absent.  Senator Brown  
         moved that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         Senator Brown moved that HB3355 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a record vote of 6 ayes, 0 nay, 0  
         present not voting, and 1 absent.  Senator Brown moved that the  
         bill be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         Senator Brown moved that SB1603 be laid on the table; without  
         objection, it was so ordered.  
          
         Senator Brown moved that HB1821 do not pass but that CSHB1821 be  
         reported back to the Senate with the recommendation that it do  
         pass and be printed.  The motion carried with a record vote of 6  
         ayes, 0 nay, 0 present not voting, and 1 absent.    
          
         Senator Brown resumed the Chair.        
          
         At 4:45 a.m. the Committee stood recessed until 4:47 p.m. 
          
         At 4:47 p.m. the Committee reconvened.  
          
         Senator Bivins moved that SB1609 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a record vote of 6 ayes, 0 nay, 0  
  
         present not voting, and 1 absent.  Senator Bivins moved that the  
         bill be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         There being no further business, at 4:50 p.m. the Committee
