         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Criminal  
         Justice was held on Wednesday, February 14, 2001, in the Capitol  
         Extension, Room E1.028, at Austin, Texas.

         The chair called the meeting to order at 1:10 p.m.  There being  
         a quorum present, the following business was transacted:   
          
         The Chair brought up SB 21 from pending business.  Senator  
         Staples had previously sent up a committee substitute for SB 21.   
         He requested that the committee substitute be withdrawn and  
         there was no objection.   
          
         Senator Staples sent up a committee substitute; the chair  
         recognized Senator Shapiro to explain the difference between the  
         committee substitute and the bill as filed.  Senator Staples  
         moved adoption of the committee substitute; without objection,  
         it was so ordered.  Senator Staples moved that SB21 do not pass  
         but that CSSB21 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 5 ayes, 0 nay, 0 present not  
         voting, and 2 absent.   
          
         Senator Bivins requested unanimous consent to be shown voting  
         aye on CSSB 21, without objection it was so ordered. 
          
         The chair laid out SB240 and recognized the author, Senator  
         Wentworth, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
  
         chair moved that the public testimony be closed; without  
         objection, it was so ordered.   
          
         Senator Armbrister moved that SB240 be left pending; without  
         objection, it was so ordered.   
          
         The chair laid out SB347 and recognized the author, Senator  
         Brown, to explain the bill.  Senator West sent up a committee  
         substitute; the chair  recognized Senator Brown to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator Moncrief moved adoption of the committee  
         substitute; without objection, it was so ordered.  
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  The chair moved that the public testimony be  
         closed; without objection, it was so ordered.      
          
         At 1:50 p.m. Senator Staples assumed the chair.   
          
         Senator Moncrief moved that SB347 do not pass but that CSSB347  
         be reported back to the Senate with the recommendation that it  
         do pass and be printed.  The motion carried with a record vote  
         of 5 ayes, 0 nay, 0 present not voting, and 2 absent.   
          
         The chair laid out SB402 and recognized the author, Senator  
         Zaffirini, to explain the bill. Senator Moncrief sent up a  
         committee substitute; the chair recognized Senator Zaffirini to  
         explain the difference between the committee substitute and the  
         bill as filed.   
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.   
          
         Senator Moncrief requested that the committee substitute be  
         withdrawn and without objection it was so ordered. 
          
         At 2:10 p.m. Senator Armbrister resumed the chair.  
          
         Senator Armbrister moved that SB402 be left pending; without  
         objection, it was so ordered.   
          
         The chair laid out SB16 and recognized the author, Senator  
         Nelson, to explain the bill. Witnesses testifying and  
         registering on the bill are shown on the attached list. 
          
         Testimony on SB 16 was temporarily postponed to lay out SB107.   
          
         The chair laid out SB107 and recognized the author, Senator  
         Barrientos, to explain the bill. Witnesses testifying and  
         registering on the bill are shown on the attached list.  SB 107  
         was tabled to continue hearing SB 16.    
          
         Senator West moved to bring back SB16 from pending business.   
         Testimony on SB 16 was then continued.  The chair moved that the  
  
         public testimony be closed; without objection, it was so  
         ordered.   
          
         Senator West moved that SB16 be left pending; without objection,  
         it was so ordered.   
          
         Senator Staples moved that SB 107 which was previously tabled be  
         brought back before the committee.  Testimony was continued on  
         SB 107.  The chair moved that the public testimony be closed;  
         without objection, it was so ordered.   
          
         Senator West moved that SB107 be left pending; without  
         objection, it was so ordered.   
          
         The chair laid out SB483 and recognized the author, Senator  
         Duncan, to explain the bill. Senator Staples sent up Committee  
         Amendment 1 and moved adoption; without objection, the amendment  
         was adopted.  Witnesses testifying and registering on the bill  
         are shown on the attached list.  The chair moved that the public  
         testimony be closed; without objection, it was so ordered.   
          
         Senator Staples moved that SB483, as amended, be reported  
         favorably to the Senate with the recommendation that it do pass  
         and be printed.  The motion carried with a record vote of 4  
         ayes, 0 nay, 0 present not voting, and 3 absent.   
          
         The chair laid out SB17 and recognized the author, Senator  
         Nelson, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         chair moved that the public testimony be closed; without  
         objection, it was so ordered.   
          
         Senator Armbrister moved that SB17 be left pending to await a  
         quorum; without objection, it was so ordered.  Upon arrival of a  
         quorum, Senator Bivins moved that SB17 be reported back to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a record vote of 4 ayes, 0 nay, 0  
         present not voting, and 3 absent.   
         The chair laid out SB18 and recognized the author, Senator  
         Nelson, to explain the bill. Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         chair moved that the public testimony be closed; without  
         objection, it was so ordered.   
          
         Senator Moncrief moved that SB18 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a record vote of 4 ayes, 0 nay, 0  
         present not voting, and 3 absent.   
          
         At 5:00 p.m. Senator Bivins assumed the chair.  
          
         The chair laid out SB219 and recognized the author, Senator  
         Armbrister, to explain the bill. Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         chair moved that the public testimony be closed; without  
  
         objection, it was so ordered.   
          
         Senator Bivins moved that SB219 be left pending to await a  
         quorum; without objection, it was so ordered.  Upon arrival of a  
         quorum, Senator Moncrief moved that SB219 be reported back to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 4 ayes, 0  
         nay, 0 present not voting, and 3 absent.   
          
         The chair laid out SB455 and recognized the author, Senator  
         Armbrister, to explain the bill. Witnesses testifying and

         chair moved that the public testimony be closed; without  
         objection, it was so ordered.   
          
         At 5:15 p.m. Senator Armbrister resumed the chair.  
          
         Senator Armbrister moved that SB455 be left pending; without  
         objection, it was so ordered.   
          
         There being no further business, at 5:20 p.m. Senator Armbrister  
         moved that the Committee stand recessed subject to the call of  
         the chair.  Without objection, it was so ordered.
