Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Senate Committee on Health and
Human Services was held on Monday, June 17, 2002, in the Capitol
Extension, Room E1.016, at Austin, Texas.

The chairman called the meeting to order at 1:38 p.m. There
being a quorum present, the following business was transacted.
The chairman made welcoming introductions and announced that the
purpose of the hearing was to consider and adopt recommendations
submitted to the Senate Committee on Health and Human Services
regarding interim committee charges.
The chairman laid out the March 26, 2002, and April 16, 2002,
minutes and called for revisions. There being none, Senator
Carona moved their approval. There being no objection, it was
so ordered.
At 1:44 p.m. Senator Carona assumed presiding duties.
The chairman laid out the mental health charge and recognized
Senator Moncrief to provide an overview of the charge and
recommendations.
Several members had questions regarding mental health
recommendation numbers 4, 6, 8 and 17.
Senator Moncrief moved that all consensus recommendations, not
including recommendation numbers 4, 6, 8 and 17 be adopted. The
motion prevailed by a vote of 5 ayes and 0 nays.
The chairman laid out mental health recommendation 4 and
recognized Senator Moncrief to explain the recommendation and to
answer questions.
Senator Moncrief moved that recommendation number 4 be adopted.
The motion prevailed by a vote of 3 ayes and 2 nays.
The chairman laid out mental health recommendation 6 and
recognized Senator Moncrief to explain the recommendation and to
answer questions.
The chairman called the following resource witness to provide
oral testimony regarding mental health recommendation number 6:
Karen Hale, Commissioner, Texas Department of Mental Health
and Mental Retardation,
Austin, Texas.
Senator Moncrief moved that recommendation number 6 be adopted.
The motion prevailed by a vote of 3 ayes and 2 nays.
The chairman laid out mental health recommendation 8 and
recognized Senator Moncrief to explain the recommendation and to
answer questions.

The chairman laid out mental health recommendation number 17 and

recommendations.

The chairman laid out the prescription painkillers charge and
recognized Senator Moncrief to provide an overview of the charge
and recommendations.
Several members had questions regarding recommendation number 6.
Senator Moncrief moved that all consensus recommendations, not

prevailed by a vote of 5 ayes and 0 nays.
The chairman laid out prescription painkillers recommendation
number 6 and recognized Senator Moncrief to explain the
recommendation and to answer questions.
The chairman called the following resource witness to provide
oral testimony regarding prescription painkillers recommendation
number 6:
Linda Schaefer, Manager, Narcotics Regulatory Programs,
Texas Department of Public Safety, Austin, Texas.
Senator Moncrief moved the adoption of recommendation number 6.
The motion prevailed by a vote of 5 ayes and 0 nays.
The chairman laid out the public health response to bioterrorism
charge and recognized Senator Moncrief to provide an overview of
the charge and recommendations.
Senator Moncrief moved that all 16 recommendations be adopted.
There being no objection, it was so ordered.
The chairman laid out the organ allocation and donation charge
and recognized Senator Moncrief to provide an overview of the
charge and recommendations.
Several members had questions regarding recommendation numbers
1, 9 and 10.
The chairman laid out recommendation numbers 1, 9 and 10 and
recognized Senator Moncrief to explain the recommendations and
to answer questions.
The chairman called the following resource witnesses to provide
oral testimony regarding organ allocation and donation
recommendation numbers 9 and 10:
Eduardo Sanchez, Commissioner, Texas Department of Health,
Austin, Texas.
Phil Walker, Chief, Bureau of Kidney Health, Texas
Department of Health, Austin, Texas.
Senator Moncrief moved that all 13 recommendations be adopted.
The motion prevailed by a vote of 5 ayes and 0 nays.
The chairman laid out the immunization charge and recognized
Senator Moncrief to provide an overview of the charge and
recommendations.
Several members had questions regarding recommendation numbers 2
and 7.
Senator Moncrief moved that all consensus recommendations, not
including recommendation numbers 2 and 7 be adopted. The motion
prevailed by a vote of 5 ayes and 0 nays.
The chairman laid out immunization recommendation number 2 and
recognized Senator Moncrief to explain the recommendation and to
answer questions.
The chairman called the following resource witness to provide
oral testimony regarding immunization recommendation number 2:
Sharilyn Stanley, Associate Commissioner for Disease
Control and Prevention, Texas Department of Health, Austin,
Texas.
The chairman moved to withdraw from consideration recommendation
number 2, as written. There being no objection, it was so
ordered.
Senator Shapleigh sent up a separate and newly re-worded
immunization recommendation number 2 (a) and (b).
Senator Shapleigh moved that recommendation number 2 (a) be
adopted. The motion prevailed by a vote of 5 ayes and 0 nays.
Senator Shapleigh moved that recommendation number 2 (b) be
adopted. The motion prevailed by a vote of 4 ayes and 1 nay.
The chairman laid out immunization recommendation number 7 and
recognized Senator Moncrief to explain the recommendation and to
answer questions.
Senator Moncrief moved that recommendation number 7 be adopted.
The motion prevailed by a vote of 5 ayes and 0 nays.
The chairman laid out the restraints and seclusion charge and
recognized Senator Moncrief to provide an overview of the charge
and recommendations.
Senator Moncrief moved that all five recommendations be adopted.
The motion prevailed by a vote of 5 ayes and 0 nays.
At 3:33 p.m. Senator Moncrief resumed presiding duties.
There being no other business to come before the committee, the
chairman adjourned the Senate Committee on Health and Human
Services at 3:37 p.m.
