Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Senate Veteran Affairs & Military
Installations was held on Wednesday, May 2, 2001, in the Betty
King Committee Hearing Room, 2E.20, at Austin, Texas.

Chairman Truan called the meeting to order at 4:35 p.m. There
being a quorum present, the following business was transacted:
At 4:36 p.m. Senator Van de Putte assumed the chair.
The chair laid out HB 116 and recognized the Senate sponsor,
Senator Truan, to explain the bill. Colonel Claude Hempel,
Colonel Keith Scragg, and Colonel Justo Gonzalez, representing
Selective Service System, testified in favor of the bill. Frank
Elder, representing Texas Department of Public Safety, testified
on the bill. Senator Truan moved that HB 116 be left pending;
without objection, it was so ordered.
The chair laid out HB 310 and recognized the Senate sponsor,
Senator Truan, to explain the bill. At 5:16 p.m. Senator
Shapleigh assumed the chair. James Nier, representing Texas
Veterans Commission, and Douglas Oldmixon, representing Texas
Veterans Land Board, testified on the bill. The chair moved
that the public testimony be closed; without objection, it was
so ordered. Senator Shapleigh moved that HB 310 be left pending
to await a quorum; without objection, it was so ordered. Upon
arrival of a quorum, Senator Truan moved that HB 310 be reported
back to the Senate with the recommendation that it do pass and
be printed. The motion carried with a record vote of 4 ayes, 0
nay, 0 present not voting, and 1 absent.
The chair laid out HB 2908 and recognized the Senate sponsor,
Senator Truan, to explain the bill. The chair moved that the
public testimony be closed; without objection, it was so
ordered. Senator Shapleigh moved that HB 2908 be left pending
to await a quorum; without objection, it was so ordered. Upon
arrival of a quorum, Senator Truan moved that HB 2908 be
reported back to the Senate with the recommendation that it do
pass and be printed. The motion carried with a record vote of 4
ayes, 0 nay, 0 present not voting, and 1 absent.
The chair laid out HB 3567 and recognized the Senate sponsor,
Senator Truan, to explain the bill. Senator Truan sent up a
committee substitute; the chair recognized Senator Truan to
explain the difference between the committee substitute and the
bill as filed. Senator Truan moved adoption of the committee
substitute; without objection, it was so ordered. Douglas
Oldmixon, representing Texas Veterans Land Board, testified on
the bill. The chair moved that the public testimony be closed;
without objection, it was so ordered. Senator Truan moved that
HB 3567 be left pending to await a quorum; without objection, it
was so ordered. Upon arrival of a quorum, Senator Truan moved
that HB 3567 do not pass but that CSHB 3567 be reported back to
the Senate with the recommendation that it do pass and be
printed. The motion carried with a record vote of 4 ayes, 0
nay, 0 present not voting, and 1 absent.
The chair laid out HB 234 and recognized Senator Truan, in the
absence of the Senate sponsor, Senator Fraser, to explain the
bill. The chair moved that the public testimony be closed;
without objection, it was so ordered. Senator Shapleigh moved
that HB 234 be left pending to await a quorum; without
objection, it was so ordered. Upon arrival of a quorum, Senator
Shapleigh moved that HB 234 be reported back to the Senate with
the recommendation that it do pass and be printed. The motion
carried with a record vote of 4 ayes, 0 nay, 0 present not
voting, and 1 absent. Senator Shapleigh moved that the bill be
recommended for placement on the Local & Uncontested Calendar;
without objection, it was so ordered.
At 5:35 p.m. Senator Truan resumed the chair.
Chairman Truan laid out HB 1924 and recognized the Senate
sponsor, Senator Shapleigh, to explain the bill. Chairman Truan
moved that the public testimony be closed; without objection, it
was so ordered. Senator Truan moved that HB 1924 be left
pending to await a quorum; without objection, it was so ordered.
Upon arrival of a quorum, Senator Shapleigh moved that HB 1924
be reported back to the Senate with the recommendation that it
do pass and be printed. The motion carried with a record vote
of 4 ayes, 0 nay, 0 present not voting, and 1 absent. Senator
Shapleigh moved that the bill be recommended for placement on
the Local & Uncontested Calendar; without objection, it was so
ordered.
At 5:40 p.m. Senator Truan moved that the committee stand
recessed for five minutes. At 5:49 p.m. the committee
reconvened.
Chairman Truan laid out HCR 176 and recognized Senator
Shapleigh, in the absence of the Senate sponsor, Senator Ogden,
to explain the bill. Chairman Truan moved that the public
testimony be closed; without objection, it was so ordered.
Senator Shapleigh moved that HCR 176 be reported favorably to
the Senate with the recommendation that it do pass and be
printed. The motion carried with a record vote of 4 ayes, 0
nay, 0 present not voting, and 1 absent. Senator Shapleigh
moved that the bill be recommended for placement on the Local &
Uncontested Calendar; without objection, it was so ordered.
At 5:57 p.m. Senator Shapleigh assumed the chair.
At 5:59 p.m. Senator Truan resumed the chair.
Senator Van de Putte moved adoption of the minutes from the
previous hearing held on April 23, 2001; without objection, it
was so ordered.
There being no further business, at 6:02 p.m. Senator Van de
Putte moved that the Committee stand recessed subject to the
call of the chair. Without objection, it was so ordered.
