SRC-TJG H.B. 9 78(1) BILL ANALYSIS Senate Research Center H.B. 9 By: Heflin (Armbrister) Finance 7/14/2003 Engrossed DIGEST AND PURPOSE H.B. 9 provides for the appropriation of fees relating to the licensing and regulation of certain electricians collected by the Texas Department of Licensing and Regulation or the Texas Commission of Licensing and Regulation under House Bill No. 1487, Acts of the 78th Legislature, Regular Session, 2003. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. (a) Provides that all fees collected during the state fiscal biennium beginning September 1, 2003, by the Department of Licensing and Regulation or the Commission of Licensing and Regulation under Chapter 1305, Occupations Code, as added by House Bill No. 1487, Acts of the 78th Legislature, Regular Session, 2003, or under Section 3, House Bill No. 1487, Acts of the 78th Legislature, Regular Session, 2003, are appropriated to the Department of Licensing and Regulation for the state fiscal biennium beginning September 1, 2003, for the purpose of administering Chapter 1305. (b) Requires any increase in state employee benefit costs incurred during the state fiscal biennium beginning September 1, 2003, in connection with administering Chapter 1305, Occupations Code, as added by House Bill No. 1487, Acts of the 78th Legislature, Regular Session, 2003, to be paid out of the appropriations made by Subsection (a) of this section and to be allocated to the appropriate employee benefit appropriation items in accordance with applicable rules of the comptroller of public accounts. SECTION 2. Effective date: September 1, 2003, if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 37, Article III, Texas Constitution or November 1, 2003.
