C.S.H.B. 11 78(1) BILL ANALYSIS C.S.H.B. 11 By: Heflin Appropriations Committee Report (Substituted) BACKGROUND AND PURPOSE Chapter 374 of the Health and Safety Code, as added by House Bill 1366 of the 78th Legislature, establishes procedures and regulation of dry cleaning facilities, including establishment of the dry cleaning facility release fund, which consists of proceeds generated from the enforcement of the Act. The purpose of Committee Substitute House Bill 11 is to appropriate funds deposited to the credit of the dry cleaning facility release fund to the Texas Commission on Environmental Quality. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS C.S.H.B. 11 appropriates all amounts deposited to the credit of the dry cleaning facility release fund beginning September 1, 2003 to the Texas Commission on Environmental Quality for the purpose of administrating Chapter 374 of the Health and Safety Code. C.S.H.B. 11 requires any increase in state employee benefit costs incurred under Chapter 374 of the Health and Safety Code to be covered by the appropriation made in this substitute. EFFECTIVE DATE Effective date of September 1, 2003 upon receiving two-thirds vote of the membership of each house. If not, the Act takes effect on November 1, 2003. COMPARISON OF ORIGINAL TO SUBSTITUTE C.S.H.B. 11 adds additional language that requires any increase in state employee benefit costs incurred under Chapter 374 of the Health and Safety Code to be covered by the appropriation made in this substitute.
