SRC-TAG H.B. 12 78(1) BILL ANALYSIS Senate Research Center H.B. 12 78S10276 JRD-DBy: Heflin (Staples) Finance 7/14/2003 Engrossed DIGEST AND PURPOSE The 78th Legislature, Regular Session, enacted Section 161.0411 of the Agriculture Code, providing for the registration of sellers, distributors, or transporters of live domestic or exotic fowl in Texas. The Texas Animal Health Commission (commission) is charged under this act with establishing fees for its enforcement. H.B. 12 establishes the appropriate fees collected by the Texas Animal Health Commission under the Section 161.0411 (Domestic and Exotic Fowl Registration), Agriculture Code, to the commission for administration of that section. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. (a) Provides that all fees collected during the state fiscal biennium beginning September 1, 2003, by the Texas Animal Health Commission (commission) under Section 161.0411 (Domestic and Exotic Fowl Registration), Agriculture Code, as added by House Bill No. 2328, Acts of the 78th Legislature, Regular Session, 2003, are appropriated to the commission for the state fiscal biennium beginning September 1, 2003, for the purpose of administering Section 161.0411. (b) Requires any increase in state employee benefit costs incurred during the state fiscal biennium beginning September 1, 2003, in connection with administering Section 161.0411, Agriculture Code, as added by House Bill No. 2328, Acts of the 78th Legislature, Regular Session, 2003, to be paid out of the appropriations made by Subsection (a) of this section and to be allocated to the appropriate employee benefit appropriation items in accordance with applicable rules of the comptroller of public accounts. SECTION 2. Effective date: September 1, 2003, or November 1, 2003.
