BACKGROUND AND PURPOSE 

The 78th Legislature enacted Section 161.0411 of the Agriculture Code,
providing for the registration of sellers, distributors, or transporters
of live domestic or exotic fowl in Texas.  The Texas Animal Health
Commission is charged under this act with establishing fees for its
enforcement. 

The purpose of Committee Substitute House Bill 12 is to appropriate fees
collected by the Texas Animal Health Commission under the Section
161.0411, Agriculture Code [domestic and exotic fowl registration
program], to the commission for administration of that section. 


RULEMAKING AUTHORITY
  
It is the committee's opinion that this bill does not expressly grant any
additional rulemaking authority to a state officer, department, agency, or
institution. 

ANALYSIS

C.S.H.B. 12 appropriates all fees collected beginning September 1, 2003
under Section 161.0411, Agriculture Code, to the Texas Animal Health
Commission for the administration of that section. 

C.S.H.B. 12 requires any increase in state employee benefit costs incurred
under Section 161.0411 of the Agriculture Code to be covered by the
appropriation in this substitute.       
EFFECTIVE DATE

Effective date of September 1, 2003 upon receiving two-thirds vote of the
membership of each house.  If not, the Act takes effect on November 1,
2003. 
    
COMPARISON OF ORIGINAL TO SUBSTITUTE

C.S.H.B. 12 adds additional language that requires any increase in state
employee benefit costs incurred under Section 161.0411 of the Agriculture
Code to be covered by the appropriation in this substitute.
